It doesn't matter if the VO's decision was incorrect. If an applicant believes a decision was incorrect as a matter of law, they need to go through the proper procedure to overcome their inadmissibility. IRCC doesn't play fast and loose with these kinds of things.

As far as IRCC is concerned, they don't make mistakes. A person who has been banned from Canada for misrepresentation, even if they allege error on the part of IRCC, must go through the proper legal process to overcome their inadmissibility and prove the ban was not valid in law. They cannot simply reapply with new documents because they are still inadmissible.

Indeed, and I can guarantee that an inadmissible person will not be approved in stage 2 because IRCC is not allowed under the law to approve the entry of someone who is inadmissible to Canada. AIP does not involve an admissibility check.

Admissibility is considered during stage 2, which is evidently not ideal, but that's how they've set it up. If he gets approved for a study permit, then he was either mistaken in his belief that he was banned (perhaps misled by a consultant), or he applied to overcome his inadmissibility with a lawyer. But there is no allowance under the law for someone who is inadmissible to Canada to overcome that inadmissibility simply by making a new application, and IRCC follows the law.

@primaprime I think you should stop wasting your energy on this thread. Clearly, the repercussions of misrepresentation lost on people in this thread and are silly enough to believe that OP will be approved in second stage eventually because WES approved document while in reality, WES evaluation has no legal standing. It doesn't matter that IRCC made a mistake or not, there are laws AND steps that applicant has to follow to overturn the decision.
