i hav a few questions,

me and my family (me, mom n brother) live in the US (no GC), we would like to immigrate to canada.

my mom will apply based on skilled worker.

i understand that children can be included as dependents? my bro is 10 yrs old. im 20 now.

does immigration authorities base age on when the application was submitted, or when it was approved? do i run the risk of "aging out" and not qualifying as a dependent?


also, since we r living in the US can we apply from here, instead of our original country?
 
Rules for skilled worker are changing so you might want to wait for the new rules unless your mom has a job offer. You can be a dependent as long as you are under 22 and not married at the time of application or if you are over 22 if you have been a full time student since before age 22 and depend on your mom for support, see http://www.cic.gc.ca/english/information/applications/guides/EG79.asp

You can apply in the US if your mother is legally admitted to the US on at least a 1 year visa or at least if she was at some point.

so let me clarify it once more, the age requirement is only based on at the time when the application is received

not when it is approved, right? i can still ride along as the dependent, even though i might be over 22 but as long as the application was recieved before i was 22?

Yes, you don't age out. It's at the time of application. They have no way of knowing when exactly the application will be processed so it would be more work for them if they had to weed out all the dependents who have turned 22 the meantime :)
 
ok thanks, thats a relief. do you have any idea on when these new rules will be coming out?
 
I am guessing 3-6 weeks but who knows.
