We adopted my hubby s niece back in our country age 9,her application was removed at the CIc level because we didn't submit a legal adoption paper to back it up,we only submitted consent letter from the father.Now we moved to Canada in 2017 we would like to bring her over now..here is my questions,
What are the step to take for the application?I don't really know the process..Anybody gone through this before ?please help!!
 
Canada will not view this as a true adoption but an adoption of convenience given her parent(s) are still alive and are related to you. An adopted child would have also had to be included in your original PR application.

Agreed. Chances are essential nil you will be able to sponsor her. As she was removed from the application, she is not considered a family member. If you are going to try anyway, I’d suggest retaining an exceptionally good immigration lawyer familiar with foreign adoptions before you even try.

Unlikely you will be able to bring her as a PR to Canada.

Which country are you from? Have you now processed the legal paperwork to adopt her? Who has she been living with since 2017?

Yes I understand that,we included her in our application and she was accepted upto provincial level but her application was pulled off at the CIc level due to lack of proper adoption paper which we have gotten now

Yes we have the right adoption paper now from our country

Yes we have the right legal adoption paper now,she is leaving with her parents now
 
Regardless of the papers, its unlikely your niece can be sponsored due to it appearing as an adoption of convenience, especially since both parents are alive and seemingly able to care for her , as you indicated she’s still living with them and not in some kind of temporary foster home

Unfortunately you will find that having formal paperwork will not change the outcome.

There is zero chance you will be able to sponsor this child for PR. This is very clearly an adoption of convenience. Even with the right adoption papers - the application will be refused. The child is not an orphan and is living with her parents. This situation does not meet the requirements for an adoption that will be recognized by Canada.

Your only option would be to bring niece to Canada on a study permit. This means you or your parents will need to be willing to pay fees of $15K per year for her to attend public school. It will be more if she attends private school.

Forget about sponsoring her for PR - it's not going to happen.

That is not true adoption it is called adoption of convenience. It won't be recognized in Canada.
