Tandang, AND MY MY MOM is there at Canada, and we hav our medical MAY 27,2014 and we passed all the requirements,then me and my father have a case, Rape case and its no bail.. and as of now, we dont have any update to are papers, and please tell us how and wat will we do, cause, we are excited to come at Cnada WITH MY MOM WITH a NEW LIFE THERE and for the future, i hope this message can read it soon as possible, thank you and God bless

I hope someone can help you.I don't really know what you are asking.Who is being charged with rape? Since having your medical have you and your father committed a crime? Or are you saying a case is waiting on rape ...

I am going to assume that your father has been charged with Rape. If so, there are three factors: if you have already done your police record check, it may not come up; if he is not convicted, he may not be inadmissible; and if he may be inadmissible, he must provide an officer with complete details of all charges, convictions, court dispositions, pardons, photocopies of applicable sections of foreign law(s), and court proceedings to allow the officer to determine whether or not he is inadmissible to Canada.

Hi, Im roxanne joy N. Tandang im 19 years old and my sister Raiza joyce N. tandang 13 years old. My Mom is there at Canada. We had our medical May 27,2014. So, aside from that, i just want to say, that My dad Rape me so i file a case for him, and now his on a jail and as of now were not done in are Hearing at court, aside from that the papers of authorization needed to sign of my father for giving his permision to stay and with my mom in Canada doesnt want to sign of my father. but its needed to pass on immigration, So we do is, we passed all the paper cases of my father to prove and understand that my father doesnt have any right for us he do.
My mom try to call on Canada Immig. but its always busy and when they answer they always say kindly wait for a call, or any email.. But we need to know if our papaers are okay or not, and when we can have our visa, to start new beggining in CANADA
sO PLEASED help us, and give us any suggestions..

Without your father's signature, you are going to be stuck there. Perhaps he may be persuaded to sign if you will drop your case against him. Then you can move on. Your papers will not be OK until CIC receives the form with his signature.

truesmile what if the bother is now the guardian would they still need permission. Surly if the father raped the daughter he shouldn't have any say where is daughter is . This is so sad

Thank you .Yes i re read it and hes in jail with no bail but awaiting the court trial ...You're right they are in for a long haul .

Did your mother sponsor you and your sister to come to Canada? Or did she sponsor your father to come to Canada, and you were part of that file? If it is the latter case, it will take a while to sort everything out. Your mother is in Canada - maybe she should consult an immigration lawyer.

He is still the father, so you need his permission regardless.

Is your mom a PR already? Or is she under a different category (such as live-in caregiver)? If she's not a PR yet, and she's including you in her application, this may cause big problems, since I believe that this would make your father criminally inadmissible, and that would affect everyone's ability to immigrate.

She should really consult with an experienced lawyer.

No it won't transfer to your mom, not at least before his case is finished and he is found guilty. Even then, this is a problem that would be best if you can make it go away . . .
