Good Afternoon
I was wondering if anyone can confirm my analysis of the current law regarding obtaining Canadian citizenship certificates for myself and my siblings. Here is the situation:
Our father was born in the US in May 1947 to Canadian born parents and his citizen certificate confirms his date of citizenship as his birth date in 1947.
My two bothers and sister are ready to apply for our certificates. We were born in March 1977, March 1979, Sept. 1980 and July 1987.
First - is my reading of the law correct our status will be evaluated under the Citizen Act of 1977 and all 4 of us became Canadian citizens at birth because our father was a citizen when we were born?
Second - if that is correct, is it correct that my brothers and I, born in '77, '79 & '80 are subject to the 28 year retention rule?
Third - if that is correct and we did not register before our 28th b-day which was before the rule was amended in 2009 (our sister turned 28 after 2009 and is not required to register) we lost our citizenship.
Fourth - if that is correct is it possible (and how likely is it) to restore our status under the interim rules promulgated in March of this year?
If the first 3 of the above are correct at this moment my understanding is our sister will be granted a certificate and my brothers and I will be denied because we did not comply with the retention requirement before we turned 28.
Basically I am looking for some guidance before applications are submitted and if it worth it for all of us to apply or just some (one) of us to apply.
Thank you in advance.
