I am trying to rent a place in Vancouver. I signed the "Application for Tenancy" form today which is by "LandlordBC".

The application form has a clause saying "If the offer is accepted and the Applicant fails to sign the Landlord's Residential Tenancy Agreement, or to take possession of the rental unit, the Applicant will be liable for the payment of the equivalent of one month's rent to the Landlord and any related expenses incurred by the Landlord".

Questions:
1. Is this a common clause? Is it legally binding?
2. I have submitted the application and now the Landlord is suggesting some new constraints like move-in fees, prepaid cheques, etc. which he didn't disclose earlier (even when I clearly asked). So I wish to discontinue the application. Is there a way to discontinue my application without paying the one month rent?
