I am posting what happened next to the above explained case. I thought it might be useful for someone in future.
I called the CIC helpline and after few hours of trying I asked them what to do. The guy said as my little boy has overstayed, the solution is to flag pole. We decided that my husband and him would do so the day after. I was worried that they won't let him re-enter Canada after leaving Canada on the US border, as we had the overstay on the file anyways. So when we got to the border, before getting to the US office, I asked the Canadian side whether they will let my son (my husband and him) re-enter Canada. The guy said we will check your file on the systems when you come back to re-enter. But there was a nice lady working there, who said I check it for you right now before you decide to flag pole.
She checked our records in the system and said nothing crazy was going on there and my son would be fine to re-enter Canada. So they flag polled and re-entered Canada successfully.
So apparently, the thing that my 6 year old had overstayed was not such a big deal, especially because we tried to solve it as soon as we noticed the problem.
They also asked how we found out that we had to get him an status and the answer was the health insurance rejected re-newing his health insurance and that's how we found out that something was wrong.
They also asked why we didn't try to apply for a visitor permit online? and the answer was, we tried but the restoration period was already passed, so it was not possible.
My son is a US citizen, but I don't think this affected anything.
I hope this helps anyone who find themselves in a similar situation. Anyways, it is always possible to call CIC to figure out what is the best solution. I was almost going to lawyer offices but a call to CIC solved the dilemma.
