Mandamus may be helpful but it's very hard to predict through.
- The leave can be granted/dismissed. At the time, the judge has a high discretion to grant the leave.
- The main test is whether the delay being unreasonable.
- For the delay caused by security screening. It's broadly acknowledged that it requires additional time, but nobody knows how long it takes. Some cases require very very long time due to the unique case complexity.
- In the court, the blanket security reason is often dismissed. But this does not imply the automatic mandamus order, the delay also depends on the judge. For example how they view the ''unreasonable delay''. As judge often stated ''ircc service standard does (e.g, 12 months) not apply to those who are in the security screening''
