Hi,
i understand that to be eligible for citizenship you have be physically present in Canada for 4 years out of 6 years
and also it is required that applicant stays in country for at least 183 days each year.

but my confusion is what is considered as an year. is it calender year? or year starting from the day you get PR

My friend got his PR on 16 April 2014, now does his year counts from 16 April 2014 to 15 April 2015 ? (and so on for next 6 years)
in this case, he has to be here for at least 183 days within this period
OR
Year is as calender year? and you have to spend at least 183 days of calender year in Canada?


i talked to cic agent but he seemed confused and told me its calender year but i am not convinced. i asked him how about people who got their PR in second half of the year and do not have enough days of year left to fulfill this 183 days obligation for that year. he said their year is lost? i am not convinced?

In this case that year doesn't count toward the minimum 4 years with 183 days.
However the days from August to December are counted toward the 1460 days. Physical presence days only count.

i am asking because i have a friend who got PR in april 2014. he stayed more than 183 days in country in 2014 and then same in 2015.
but this year due to some personal obligations he cannot come before to canada before july and hence wont have enough days to full fill his 183 day stay requirement for this 2016 year.

can he stay in Canada for less than 183 days this year and those days would just count towards the 1460 days.
and then maybe he can stay for at least 183 days or more here for next two years (2017, 2018).
OR is it suppose to be that person has to stay in Canada for 183 days oor more for continuous 4 years.?

These 183 days doesn't have to be in a continuous 4 years. It can be any random within the last 6 years.

The most accurate way for that person to understand when he/she will be eligible is to use the online calculator. When he/she enter all his absences the online calculator will show when he/she will be eligible according to his/her situation.

now the law is revesreing and soon it will be same as previous so don't worry about 183 days

I read multiple post about calculating citizenship residency requirement but I am still confused on 1 point:-

Do I have to stay for 183 days out of 365 for each of 4 years immdiately before I file my application.

For example, if I stayed in Canada
year 1: 365 days
year 2: 365 days
year 3: 365 days
year 4: 0 days (going overseas for a job)
year 5: 365 days

Can I still file my application, or will I be ineligible as in one of 4 years before (year 4) I did not stay for minimum 183 days in Canada

If you can please let me know

In this scenario you are good. The rule is any 4 years in the last 6.
These 4 years can be random in the last 6.

today my immigration consultant said its clearly mentioned online that the 183 days (or 6 months) has to he continuous at a stretch, but i couldnt find it anywhere! can anyone confirm please?

Your consultant is wrong. 183 days can by done also cumulative

It seemed a bit strange to me cos I personally didn't see the word "continuous" anywhere online but she was very confident and said its mentioned clearly online, so I thought I would ask here as well.

If your consultant is wrong about basic things like that, I would look for a different consultant.
Preferably one that is not clueless...

As stated by several of the previous posters, also keep in mind the fact that the 183 days requirement applies to calendar years (January 1 to 31) that are partial or fully within the six year period immediately preceding the application.

If you have never left Canada since becoming PR, the earliest you can apply would be exactly 1460 days after the day you landed, regardless if you land before or after July. For example, let's say you landed on December 1 2015, then the earliest you can apply for citizenship would be after December 1 2019 if you choose to stay in Canada the entire time. In this case, the six year period considered preceding December 2 2019 would the period that goes from December 1 2013 to December 2019, and if you count the number of calendar years, there would be seven calendar years within this six year period (2013, 2014, 2015, 2016, 2017, 2018, and 2019).

If you have never left Canada, then you would have stayed for more than 183 days in each of the calendar years of 2016, 2017, 2018, and 2019, so despite the fact that you landed so late within the year, you can still apply exactly four years after you landed (again, assuming you never left Canada within this four year period).
