Bill C-12's Nearing Royal Assent and Refugee Claim Eligibility

If on or before June 2nd 2025, no, if on or after June 3rd 2025, yes, as per Clause 75 of Bill C-12: "75 Paragraphs 101(1)‍(b.‍1) and (b.‍2) and subsection 101(1.‍1) of the Immigration and Refugee Protection Act (a) do not apply to a claim for refugee protection made before the day on which...

Bill C-12's Nearing Royal Assent and Refugee Claim Eligibility

https://www.parl.ca/DocumentViewer/en/45-1/bill/C-12/royal-assent I think subsection Immigration and Refugee Protection Act 101(1.1) has to be read together with the condition at the start of the sentence. It begins with: “if the claimant has entered Canada more than once after June 24, 2020”...

Bill C-12's Nearing Royal Assent and Refugee Claim Eligibility

At this point it's hard to say, my personal best guess is that it will be deferred from the IRB and offered a PRRA. But officers have discretion, as they could allow the case of a minor to be referred to the IRB despite being ineligible under IRPA paragraph 101(1)(b.1)

Bill C-12's Nearing Royal Assent and Refugee Claim Eligibility

So let's say you entered Canada for the first time in 2018, then later again in 2021; the 2021 date counts.

Bill C-12's Nearing Royal Assent and Refugee Claim Eligibility

The entries before June 24, 2020 don't count towards the 1 year bar, but the earliest entry after that date does.

Bill C-12's Nearing Royal Assent and Refugee Claim Eligibility

https://t.co/CMtVJDjVuZ Suggests that, anyone who is affected by the new ineligibility rules will be offered a PRRA. So you won't be immediately rejected, rather will be pulled from the IRB/RPD process and moved to a PRRA process.

    Mistake on BOC Question 3

Hi, I made my refugee claim in April 2025, and so far my claim has been deemed less complex with no possible exclusions. I can't get a lawyer, and can't get legal aid; so I ended up self-representing myself. In my Basis of Claim form, on question 3 "List the country or countries where you...

    question.. departure order.....urgent

Start collecting documents if you haven't already. If you're able to prove what you're saying and answer any questions the minister's delegate may ask, you can get accepted.

Bill C-12's Nearing Royal Assent and Refugee Claim Eligibility

As far as I know, no. You will likely be offered a PRRA without waiting.

There's nothing you can do about it, except for being prepared for your hearing.

Refugee PR application: asked for supple documents again even though GCMS says it was received?

Maybe you could call IRCC to confirm it. Otherwise your idea of resubmitting them with a short letter makes sense to me.

Bill C-12's Nearing Royal Assent and Refugee Claim Eligibility

Unfortunately, no. The Senate did not adopt any amendments to Bill C-12 that would allow refugee claimants who filed after 3 June 2025 to remain eligible if they had already been in Canada for more than one year before making their claim. The bill maintains the new ineligibility provisions added...

    I didn't succeed in doing so, I don't think it's possible.

Is FESS and Security Screening in the IRCC Portal the Same Thing?

Hello everyone, I noticed that my Background Check was completed in the IRCC Portal. I wanted to ask if this meant that the Front-End Security Screening was also complete and transmitted to the IRB. Thank you for any responses.

Bill C-12's Nearing Royal Assent and Refugee Claim Eligibility

This is an accidental repost of another thread by me named the same, please ignore this one. I'm sorry for the inconvenience. With Bill C-12 nearing Royal Assent, individuals considering a refugee claim should understand how the amendments affect eligibility under the Immigration and Refugee...
