Hi Everyone I was wondering if someone would give me the best advice on which way to apply with my family?

I am married with my wife (American) and I'm Canadian and have been living together for the past 5 years however we have 2 step-children (Wifes Kids) together along with our own children which they have been up in Canada for the last 5 years attending school and me taking care of them (I am Dad to them). We never applied for her PR status since she was back & forth between the US & Canada but now we need to get this done as to avoid issues however the 2 step-children have been here for that long and obviously overstayed so I was wondering what would be the best way to approach this as I don't want to lose them. Thank you for your help!

Have they been paying international fees? What province have you been living in? Have you paid for health coverage for the children? Your wife? Is your wife working?

When you sponsor your wife, the children will be included as dependents. You will need to be completely honest about their lack of status in the app.

Agreed with this. You just need to be 100% honest. They will still be approved.

Make sure your wife has the legal paperwork that shows she either has sole legal custody of her kids or has the father's permission to have them immigrate to Canada. Should be pretty straight forward.

Yes she has sole-legal custody of them but since the father is nowhere to be found and has never been in there lives I guess I wouldn't fill out form IMM5604 and just include the documents and explanation letter?

Thank you so much guys for the help and support! This forum has been really helpful so far and I guess it would be best to do an OUTLAND application from what I have been reading so far?

Happy to hear that although this person has delayed sponsoring their family they have done things correctly and paid international fees and taken out insurance. Every Canadian should ask whether visitors are paying international fees for schooling if a child does not qualify and health insurance if they don’t qualify for coverage. I asked because in some provinces the wife would at least qualify for healthcare.

Am concerned about the healthcare system and limiting the demand to only those who qualify. If you have used or work in the healthcare system you would also be concerned. On top of that I remind people about separate RO for healthcare because most are totally unaware.
