Open Work Permit Denied - Vienna Office

Hey there,

I applied for an OWP (29th of August) from the Netherlands and my husband is a Canadian Citizen.

Today I received a message saying it got denied on the following grounds:

• You have not demonstrated that you come within the exceptions under section 186 of the IRPR exempting you from the requirement to obtain a work permit or that your employment in Canada comes within the exceptions to section 203 of the IRPR. As a result, your offer of employment must be the subject of an economic effect determination before a work permit can be issued to you. Your employer in Canada should contact the local office of the Department of Employment and Social Development Canada to begin this process.
• No evidence that you are married. No evidence that your spouse is a foreign worker or a foreign student in Canada.

I applied for a non-job specific OWP.
Does anyone know what this means and how to go about it?

Hello Leena,

For the first point,
I am not so sure or clear about it since it says exemptions.
it says that your offer of employment from employer is not correct , they should contact the local office, i would suggest you contact the company attorney and ask them to contact local office.

For the second point,
you may need to submit the proof of your marriage. this can be any or all possible of the following.
1. Marriage Certificate.
2. Pictures of you wedding.(as many as possible for them to believe).
3. if you got married outside Canada, proof of you spouse travelling to you place(Flight Ticket or Boarding pass).
4. Reservation of venue(wedding venue).
5. Copy of wedding invitation.

I understand it is sad to be away after your marriage, attach and send all the possible documents to prove legitimacy and hope for the best.

Thank you so much. I applied for a non-job specific work permit, thus i dont understand where they base the first point on. Its impossible to get a hold of them via phone. - But hey thanks for helping out!

You mean you applied for Spousal Open work Permit??....

Answer is much simpler. She doesn't qualify for an OWP. Even if she does as you've suggested, the application will still be refused.
