Hello All

I am asking for a friend here. She basically got her PR card in March 2021 and the PR card expires in March 2026. She hasn't met RO though she was working for a Canadian company and was in India handling a part of their operations too. Also majorly she being the only child to her parents had to stay back in India because of her mother's health which was a major reason of not meeting the RO. She basically has stayed 298 days in Canada until Dec 2023. And after that she has been working with a Canadian company. In between the abroad working period as well she did make frequent visits to Canada which were I believe around 150 days and was part of her contract. She even purchased a pre- construction condo property in April 2024 during her visit which has an expected timeline of Sep 2027 closing. She is wanting to submit her PR card renewal application as she is in Canada right now.

1. Do you think she has chances of getting the PR card renewed based on her tie back to Canada in terms of property purchase and other financial investments done in Canada?
2. Can she use her mother's medical reasons as a ground for H&C for not meeting the RO along with the employment documents?
3. Should she go ahead with paper based application or should apply online.


Anybody who has been in similar situation and can help us here, I would be really thankful.

She would be much better off just waiting until she is compliant with her RO. Also 730 days based in the past 5 years is based on landing date not PR card dates.

1. If she is in Canada then once she meets RO then renew. Home or investment is not a reason to be renewed.is
2. Her PR card expires in 2026 so again meet RO and then renew. She only left in 2023.

Most likely no. She will apply and will leave and is planning to come back in Jan. But yes processing for such cases takes longer, that’s what I have read online. Can she apply based on H&C grounds?

Yes, of course she can apply on H&C grounds. The visa officer has to take anything into consideration. But be aware this is risky. If they don't deem the reasons sufficient, they will likely start the process of revoking her PR.

As others have said, the best approach is to remain in Canada until the RO is met, and then apply for PR renewal.

No point applying until she is prepared to remain. Not being in Canada weakens her case dramatically.

I don't see point in applying at this point either. She should decide when she's going to settle in Canada, and do it then - and be prepared to remain. As it is she is risking the PR status.

If she wants to continue residing outside Canada - well, at some point, that's not compatible with being a permanent resident.
