HI @Simba112

I have a Canadian RTD and still waiting to be granted PR but I have a job offer in the USA will l be able to get a work visa in the US?
I thought “zulubia” mentioned about abusing US visa and cross illegal to Canada. I want to believe, abused means overstay.. if that is the case then they will raise this during interview

Hello, when I was in the US with a visitor visa in 2019, I crossed the illegal border to Canada to seek asylum. My refugee claim was accepted and now I have a refugee travel document. I really want to visit my friends in the US again but I am scared to apply for visa since I abused my first visa and left the country illegally.
I was wondering if there is anyone with the same experience as mine and applied for visa?
Hi, i am wondering if you were issued the visa? How did the interview go? I have a friend in the same situation and is very nervous.

Pretty unlikely to be granted because you have minimal ties to your home country and would permanently close pathways to Canadian citizenship and PR for most so incredibly risky unless you are happy to return to your home country.

What are you talking about? I asked a question specific to Zulubia post.

Unless a recent decision under the current administration would be pointless to compare. Under Biden there was mixed outcomes and was also dependent on previous immigration history and ties to Canada.

I just got my rejection for US visa on RTD, had a group appointment of family of four, officer asked 2 questions and said interview is over. I previously had a US visa never violated the terms, visited US two times , one in 2016 for 1 month and another in 2021 for 2 months. We 4 family members are permanent resident of Canada, I also bought a house last year, and we had a UK visit visa issued 3 months ago and I travelled to UK and Italy on my RTD.
Reason that he gave me is the same everyone gets that I don't have strong ties to Canada. Although, I told him about my job and school and family occupations had all the documents with me, but I guess he made up mind 10 mins before interview. I believe trump administration is working hard to grab our visa money and also now they have introduced the visa integrity fee of USD 250.

I hope you all get visa, because at appointment section there were good visa officers also, but we got unlucky and now will not be able to attend a wedding. For me it is not a big deal and not gonna apply again because I am gonna get Canadian Passport in a year or so, but feeling sad because I thought having a PR, job, school and home is very strong case plus also been to USA before.

Nope, we had a anchor relative crossed border through Fort Erie and also emailed US customs and border about leaving United States prior to CBSA appointment. The visa officer didn't believe us that we will come back to Canada, he thought we gonna take asylum in US.

Your improper use of your US visitor visa could be the issue. I assume you did not declare your intent to claim asylum in Canada when you landed in the US and declared other intention like tourism.

It could be, but I took appointment at Canadian border from CBSA it took 2 months, it is a safe third country that was being talked about and if you had anchor relative in you can come to Canada legally safe third country does not apply on that, many people did it this way and still get visa, I know my community friends, only thing not common is trump administration, also ICE is getting famous day by day in news, how they are messing up Canadian citizens and even few US citizens and green card holders when they re enter usa. Once I get Canadian passport, I guess will be able to travel to USA if not, I don't care will wait for next administration.

You still used your US visa for purposes other than visiting the US so the US would consider that you lied when applied for the B1/B2 and/or when you entered the US. I assume you did not declare you planned to claim asylum when landing at your US destination and likely said you were on a vacation. What was possible under the Biden admin or even first Trump is not really relevant anymore. Although US immigration has definitely changed their enforcement Canadians have always gotten denied entry into the US just like Canada denies US citizens. You still have to meet a certain criteria, have a good reason for visiting, have to have the funds to pay for your visit, your immigration and travel background is always considered, etc. Entering a country remains a privilege and you are never guaranteed entry into a country even with a visa.

I understand the importance of accurately declaring the purpose of travel, but I believe there's a key difference between misrepresentation and changing circumstances. At the time of my visa application, my intentions were clear and aligned with the visa type. It’s important to note that under different administrations, the policies and enforcement around immigration have fluctuated. While the system is built on merit and criteria, the recent shift toward more restrictive policies has made it harder for people with strong ties and financial stability, like myself, to gain entry despite meeting those criteria. The U.S. immigration system should remain consistent and transparent, not subject to changing political climates that can impact fair decision-making. Now I don't know, if I will get trouble entrying US after Canadian passport because of my refusal on RTD with PR.
