Hi all,

My husband might move to Canada for an on-site opportunity. I will be going with him on a dependent Visa, but I would like to continue working for my Employer.
Now since WFH is the new normal, can I remotely work from Canada as an Indian employee?

Please suggest.

There is no such thing as a dependent visa. You should be applying for an OWP as the spouse of closed work permit holder. Does your employer have offices in Canada?

Hi, thanks for your response... I meant I'm going with my husband as dependent. Me and my husband are working in same company and yes my company has offices in Canada, but they have a policy that WFH location should be only within India..I have another offer from another company which also have their offices in Canada but not sure if they have such policy like WFH location should be only within India. So looking out for options to work from Canada as an Indian Employee. I just wanted to know if it's legal, whether Canada authority allows that or not. Please let me know.

It's legal from Canada's perspective.

Do you have a visitor visa or a SOWP? There is no visa to go with a spouse with work permit as a dependent.
You either get a SOWP or a visitor visa that you will need to extend your stay when your stay expires.

If you are on a TRV then you can’t work for your Indian employer if they have offices in Canada.

Do you have a visitor visa or a SOWP? There is no visa to go with a spouse with work permit as a dependent.
You either get a SOWP or a visitor visa that you will need to extend your stay when your stay expires.
I will be getting SWOP. So is it possible in that case?

Then you can legally work in Canada. Talk to your office and since they have a Canadian office, they should transfer you there and you can work for that office.

And btw unless your husband's close work permit include your SWOP (so if they approve, they approve both), there is no garantee if your SWOP will be grant. So may be wait for that to happen before you request a transfer/switch office.

Hi thank you for your response, but one more concern, my husband has not applied for SOWP yet, he applied only for himself since we were not sure whether I can work there or not... So if his Visa gets approved he will be going alone for now and I'm thinking to join him later after few months... In this case can he raise request/apply for SOWP later? Or it should have been applied along with his application?

As I said, he can apply later but approval is NOT guaranteed. Be prepared for both outcomes. You may or may not be able to join him.
