Hello everyone,
I am in Canada as a visitor, and I help my sister to take care of her kids and house as a caregiver without a work permit. I have read that I am eligible to apply for PR under Federal Skilled Worker Class. Am I eligible to apply for a work permit within Canada after I apply for PR under EE?. Some people say yes. However, read that I can be only eligible if I apply under family sponsorship in Canada or TRP, so it seems my situation does not fit. Please give me some advices.

If you are in Canada and working as a caregiver for your sister, you are working illegally.

1. If you are eligible for Express Entry - FSW, then apply. You need education assessments and language test completed before submitting a profile. You need at least 67 points to be eligible and 468 points for an invitation. It is based on skilled work experience
2. You are not eligible for a work permit by applying to Express Entry as you are a visitor. You would need an invitation and then wait for PR. If you have a masters, you have a chance for an invitation.
3. You are not eligible under Family sponsorship unless you are under 22 and your sister submits a profile for the PGP which would include your parents and you. She needs to meet LICO for at least 3 years. It is by lottery once a year and some people are never selected.

- What you are doing right now is classified as working illegally.
- You can certainly apply under FSW if you qualify (you would apply through Express Entry). To qualify, you would need to have at least one full year of work experience in a skilled profession. Working as a caregiver is not classified as a skilled profession and you also cannot count any of your work in Canada towards a PR program since this work experience was obtained illegally. You would need to have the required work experience from outside of Canada.
- In order to be sponsored under family sponsorship, you would need to have a spouse or common law partner who is Canadian. Your sister cannot sponsor you.
- A TRP is only for temporary stays and is not a way to get PR
