Outland Spousal Sponsorship

I am guessing I will find out an answer here. I am the Principal applicant and my husband is sponsoring me to Canada. I have a Deportation Liability from New Zealand a year ago. Can I still apply to Canada PR? Will it raise any issues for my application? BTW I left NZ within few days of receipt of the liability notice. So NZ did not give me any order.

Why did you receive the notice? Was it due to a simple visa overstay or more?

Assuming it was due to a simple visa overstay, then you would just want to make sure you answer yes to the spousal sponsorship application that asks if you've ever been refused entry or ask to leave Canada or another country. Provided you answer this question truthfully, there shouldn't be an issue.

It was due to a DUI but the DUI was later removed from my police records after going to the court. Does the Deportation Liability count as asked to leave country? It’s information that you may be asked to leave the country right?

Yes, the application asks if you've ever been asked to leave. You should definitely err on the side of caution and declare this in your application as being asked to leave the country.

For the DUI, were the charges dropped in court? I assume so. You will need to declare in the application that you were arrested and then provide the details of the charges being dismissed. You'll want to include the court documents.

The lawyer who helped me to get out of the case said I don’t need to disclose it any where because they completely removed the conviction out of my records. When I requested for a police check it showed no criminal records found

You’re right. However, apparently, IRCC is in contact with a lot of agencies, so they might be able to know what happened to you. And imagine if the agent in charge of your file is from those pathetic severe agents.

Yes and the lawyer explained that if the discharge of conviction is granted then the total case is not considered as convicted. So for the question which says have you been convicted? I answered No
