Hello everyone,

Due to my father's health. we have to urgently travel to India. My wife's PR in process, she had post-graduate work visa which is recently expired. Now we have to go to India urgently. What can we do by the way I am on pr from last 3 years and applied for citizenship.

What is our best option.her visa processes say 100% complete but we have not received any updates from the CIC . please advised

Thank you so much

If it is an inland application.. There are a few problems that could arise.. I would avoid traveling outside of Canada at least in my opinion.. If she does travel outside of canada it could be seen as a abandonment of application.. Sadly i wouldnt know anything you could do to get around that..

Is her work permit expired? If so, you have to apply to restore her status as visitor and the apply for work permit based on spousal PR application. It is impossible to get these processed immediately with current processing times.

Since she is an inland applicant, she is expected to stay in Canada all the time. Even if she has valid work permit and visa, she would not be expected to stay out of Canada for more than 3-4 weeks. You are also a PR and so you can't stay out of Canada for more than 3-4 weeks until your wife's PR is approved.

If she leaves Canada without a valid status, she has to wait until PR application is approved and submit passport to local visa office. Also, she may have to explain why an inland applicant is submitting passport outside of Canada.

Not sure why you are recommending to restore status.

The progress bar is a visual representation of sponsorship process but I believe it is still set to precovid timeframe so you can sit at 100% for a while. It is extremely bad timing to have to return to India. Does your wife have a TRV? If not she won't be able to return to Canada. If she can't return to Canada your inland application will likely be denied. As previously mentioned you both need to remain in Canada but a visit of 2-3 weeks seem to be overlooked.

Thank you so much for your detailed answer. I appreciate a lot.
