Are you still in a relationship? How long have you spent living together and was there a reason you did not return to Canada with him?

It is 7 years of marriage and 8 years of relationship. We both came back to India to get Work experience. We dint plan to go back at that time. Recently we decided to move back. Last month he left for Canada and he got a job. Last year my PR expired. I dint notice that.

Let me first try with PRTD and then decide. What kind of questions will be asked for the PRTD process? Any of you know, whose PRTD is approved without meeting the requirements.

When does his PR card expire? Is he compliant with his RO? You would need to have proof that you had exceptional reasons why you couldn't meet your RO to be approved for a PRTD based on H&C. Gaining work experience is not reasons to not meet your RO.

His PR expires by end of 2021. Yes I know, gaining work experience is not a valid reason. I had a health issue, and I have those medical reports. will that be valid?

Is your husband himself compliant with his residency, 2 years out of last 5 years given until he is compliant he could not sponsor you again for PR, PR card expiry date is not relevant to anything other than need a valid card to travel to Canada.

Health issues as a reason for not meeting the residency obligation can be a 50/50 chance of suceeding with an H&C reason although if the medical event occurred when you were you were already out of compliance or close to being out of compliance the odds start to reduce.

There is no way of course for anyone to predict whether a PRTD application would succeed given in filling out the form it becomes obvious if someone has not met the residency obligation .

Nothing to stop you submitting a PRTD application though along with any supporting H&C documentation in support given renouncing your PR status should be the last resort. WIth COVID maybe be prepared for a PRTD application to take some time, although never has been a published processing time even pre COVID suspect times are more unpredictable.

You would have had medical coverage in Canada so you'll need to show that there was no way to receive treatment in Canada and that your treatment went on during all those years and you were too ill to travel.
