Hi - I am in Canada on work permit since November 2018 and my case is an inter company transfer and I have with the company since ten years. My employer has extended my contract by one year and work permit extension just commenced. I created PR profile since March and claimed 50 points for job offer with contract valid till October 2021. Initially I uploaded offer letter with contract extended till October 2021 and got AOR. But after reading several pages I reached to my Hr and they have added to my employment letter_ Mr. Xxx has been employed with us since November 2018 and he was permanent transfer from this country and we extended his contract in anticipation of him receiving PR by October 2021. A review to extend contract and offer permanent role will be done at later stage.


This wording was approved and done in consultation with our firms immigration attorneys. Do you think it helps. I just uploaded this attachment through web form today.

Just to add i have included all my previous contracts , experience letters from other offices where I have served with bank statements and payslips which goes to show my connection and long relation with the network

No it is useless. It doesn't state that you'll be employed for at least one year after becoming a PR.

A contract until 10/2021 with a potential extension into a permanent position is not equivalent. Because you're currently in a work permit, even if you have a permanent position it is actually temporary set to expire when your work permit does.

Also, do you have a LMIA? If not, are you in a LMIA exempt situation?

In most cases à LMIA is necessary to claim 50 points for arranged employment...

It’s LMIA exempt and my work permit says exemption number. The wording were included in accordance with advise from my company’s immigration lawyers. Tough to expect any employer making firm commitment but in a way my employer helped me out by clearly stating that it’s permanent transfer from other office across globe and not temporary deputation. I have clear track of working with my company for 10 plus years across 5 countries. That’s what I was being advised for to be included in my application

Assuming it meets the requirement is there any way I can upload these additional documents since I received AoR already.

The fact that you were transferred from your company means nothing.

What you are not understanding is that the letter has to EXPLICITLY state that you will be employed for at least a year (or permanently, what ever it is) once you become a PR.

All you letter says is that a contract extension or a permanent position will be evaluated at a later stage. The fact that you have a contract until Oct 2021 means really nothing since you don't know when your application will be approved and some applications take over 1 year, even 2 to be approved.

If you search in the forum you'll easily find many cases of people with permanent positions whose applications were rejected for making the same mistake you are.

You could always get lucky and maybe, maybe, have the officer reviewing your application oversee this and grant you those points but you're still taking a huge risk because you're not actually meeting the requirement.

Lastly, yes you can use the Webforn anytime to submit any additional documents...

OP is on an ICT. So no need for the LMIA since they have worked in Canada for a full year.

However agreed about the contract. It's useless as you've said. OP needs to get a letter from their employer specifically stating they are being offered a job for at least a year after PR.
 
Thanks for responses. At this moment i understand my employer can provide what has been mentioned above in consultation with our Legal Immigration Team which handles all work permit applications. They drafted these wordings for me with their historical experience that they have not seen refusal with these wordings as my employer do get staff on permanent transfer and eventually they get PR and than they get local permanent offer. Its more to do with legal angle wherein the your job offer exactly matches with your work permit.

So, if for sake the officer checks with our employer as background check for sure they will get a note stating that generally staff who are on permanent transfers are localised and given permanent offers , similar to what has happened in the past. I can add this in letter of explanation or perhaps additional supporting evidence in case officer asks for

Sure, but my colleague recently got approved as he claimed points for job offer say with 1 year and few months validity , he got note to explain and provide additional information such as association with the company and he was approved. I would say it’s more of common sense on part of officer and reading the intention behind rule rather than following rule book strictly. That’s what gave me confidence
