hello i am confused about this two .i overstayed my visa for a long time 10 years but went back to my home country because my dad was gravely ill and left my two children in canada .they hav been involved in an accident in canada .i would like to visit them for a few weeks but come back as i am my fathers caregiver .with this virus i just want to make sure they are ok as well i have applied for outland common law application as well when i came back and have mailed it .which of this two application should i apply .my only connection to my home country here is that my father is ill and i have medical notes and cities notes to prove it .

You need to apply for a TRV (temporary resident visa). You should assume it may be quite difficult to be approved with a 10 year overstay.

thankyou .one of my other for overstay was because i had two other children that died .when i was there .and i just want to visit their graves as well as their bday is coming up this may .they were ill when i was pregnant with them but died a few months after birth .i also could leave the other two children as they had mental health problems .all of them are candian citizens

i’ve been here for three months .plan was to wait for the outland common law to be approved but i just want to visit my children a few weeks or maybe one week if they allow me because they got in to car accident last week and i have doctors note and police report to prove that .i also have doctors note from the hospitals and medical certificates to prove i am the caregiver of my father and need to come back too .

You should assume it will be very difficult to get a TRV approved. There's a very good chance you will have to remain outside of Canada until your outland sponsorship application is approved. However you should certainly try applying and see what happens.
 
even if the children are still minor ? oh no that’s also quite unfair for countries that they let in like refugees since my husband has been paying taxes but i hope my case will be a special case anyone here ever had this situation before .

Yes - even if the children are minors.

This has nothing to do with refugees. It's because of your immigration history in Canada. By overstaying in Canada for 10 years you demonstrated that you don't follow Canadian immigration laws. That's why you're in this situation.

Anyway - all you can do is apply and hope for the best.

thankyou so much .of course i know it’s gotta nothing to do with the refugees .its just my two cents of opinion .i do hope my chances for the outland common law are high .i wonder how the timeline is for MVO now that i think they’re working on south koreans going to canada first .on another note my partner forgot to insert his NOA but provided a letter of employment
 
How did you healthcare for 10 years unless you are living in Alberta? You had multiple children in Canada. Why did you not regularized your status for 10 years? Would assume that chances of TRV are extremely low. You must have realized that having overstayed for 10 years.

as a work permit holder from 2002-2009 .then my status was not restored anymore .i couldn’t leave my child because he had mental condition and we had to see doctors and doctors and wait was long i was his advocate .in school and his well being .then i got pregnant again but the child had a heart defect so it was harder for me to leave because s he died .i didn’t want to leave my children as it will impact them physiologically .i came home because of my dad gravely ill and he still is i take care of him i am his nurse ./caregiver .i will be back too here as the reality is he doesn’t leave long .so i don’t know if a return ticket will help my trv application

Don't buy an airline ticket until you know if the TRV is approved or not. A return ticket will not increase your chances of approval.

Also, given COVID-19 isssues, there are likely to be further flight restrictions / cancellations.

Unfortunately your promise to return to Manila even if you have a return ticket means very little after overstaying your visa for 10 years. I think you will need to plan and remain in the Philippines until you get PR.

thankyou for your advice .i asked they said there is a direct flight from manila to philippines .thats why i was hoping to apply now .i miss my children so bad and they miss their mommy too .but mommy had to stop hiding .
