Should I apply for PRTD?

Hello all,

My parents were planning on moving to Canada, and obtained PR cards for this. However, we did not end up actually going. I still have my PR Card, which was activated during a trip to Canada, and should still have my PR status (as this won't be automatically revoked). My card was activated when I was 8. I never returned to Canada since this trip back in 2006. I have always wanted to live in Canada, and was sad we did not end up actually going there.

Since I have never actually lived in Canada, I have not met the Residency Obligation. I am wondering whether I would have a shot at obtaining the PRTD using the H&C grounds, as I have been removed from Canada as a minor by my parents. I am 20 years old, soon to be 21. I know it would have been better if I had applied for the PRTD when I was 18, but I wanted to finish my BSc first. Would they be compassionate about this, and see this as a valid reason why I did not immediately apply when I was 18.

A PR card would give me the opportunity to pursue a Master degree in Canada, paying the domestic tuition fee instead of the significantly higher International Student fee.

Also, if I were to get the PRTD, would I have to use this immediately or within a certain time period. I.e. would I be able to wait another 6 months before actually using the PRTD? Then, if I would arrive in Canada with my PRTD card, would it be possible to immediately also get the PR card using the H&C grounds? It would be weird if they hand you a PRTD on those grounds, but not the PR card.

Added: would the fact that I am fluent in English, intermediate in French (have certificates) and have a BSc any influence on their decision if I would be eligible for H&C grounds .

Thanks! If I were to cross the border, would I be able to live a normal life, e.g. could I get a job, open a bank account, rent an apartment, get into university as a PR? Also, would I have to show my expired PR card when I cross the border?

In general, yes. The only thing is you may not have a SIN yet, and you usually need to show a (valid) PR card to get one. I do believe there are other ways to demonstrate that you are a PR, but I don't know much about it. Maybe others can help.

In regards to job (once you have a SIN), you would need to get a job that doesn't require you to travel outside Canada for two years.

I believe you would show your expired PR card at the border, but again I'm not too sure. Maybe pay for a short consultation with the law firm that wrote the short blurb above (or any other one).

You might or you might not - I would expect bumps. If you obtained a SIN when you were here - things will be a bit easier (you need a SIN to be able to work). Without a SIN and/or valid PR card, you may have trouble getting health care coverage and you won't be able to work. Also, schools sometimes require that you prove your status by showing a valid PR card.

How long were you in Canada when you initially received your PR card , then left ?
As well how old are you ? The ages in your original posting don’t add up

That was 14 years ago, that would make you either 22, or turning 22 this year
Age is very important in these situations
Having extended family relatives isn’t relevant here . They aren’t the reason you are applying for a PRTD
And there was schooling in Canada where you could of applied for the PRTD earlier at 18, and completed your BSC here
So you were aware of the PRTD @ 18, but elected to wait, that possibly could of been an unwise choice

We were there for a week to get the PR cards etc. I had It wrong in my OP, I just turned 7 at the time. I'll soon turn 21 (So I'm 20 now) and by the time I'd be able to go to Canada I'll have just turned 22.

Maybe I could already start applying for the PRTD already, now that I'm 20, to give me a better shot. However, I don't know how long the PRTD will be valid for.

A week is an extremely short time , shows no original connection to Canada . In other words some people vacation longer in Canada , than your original stay was, the clicker is that you want the authorization to remain permanently
It used to be easier in the past yo get PRTD in these situations, not anymore . The IRCC is getting stricter in their issuance, especially when the first goal is to pay domestic student fees, as you mentioned, when a person has little connection to Canada

Would the fact that I have family living in Canada (Aunt & cousins, some of whom are citizens) show a connection with Canada?

Zero chance a PRTD will be approved in my opinion. Based on what we've recently seen on this forum, PRTDs are now only being approved in these situations if the family actually established themselves in Canada for a number of years before leaving. Your family never established themselves so the PRTD will be almost certainly refused.

Yes. If you're admitted to Canada by border officer at POE with your COPR or landing paper, you will be able to do all that as a PR. Even, you might be able to get a SIN. A PR card is basically to show your status when travelling outside Canada.
