Sponsoring same-sex common-law partner

We are looking for some opinions on this complicating situation.


We have been living together since Jan 2018. My partner applied EE in Dec 2018 and got the CoPR in Oct 2019. We didn’t intend to hide this relationship but he never mentioned this relationship in any immigration applications.

If my partner wants to sponsor me now, how likely the IRCC thinks that our relationship is valid? Should we wait for another year before we declare our relationship?

If your partner didn't declare you during his application, the question isn't validity of the relationship, it's whether or not you are barred from being sponsored.

IRCC requires that spouses be declared and medically examined. If you don't declare, you may not be able to be sponsored.

We are both Asian and it is difficult to come out as a same sex couple in our culture.


If my partner wants to sponsor me now, how likely the IRCC thinks that our relationship is valid? Should we wait for another year before we declare our relationship?

Has your partner landed as a PR? If so, he committed misrepresentation by not including you and you are excluded from the Family Class, meaning he can never sponsor you.

If he hasn't yet landed, he can still add you.
