Visa rejected due to family ties in Canada and in country of residence, travel history

Hi ,
I am a central government employee , I applied for VISITOR'S visa to meet my gf who has gone over there to pursue her MS last year for 8 days.

I have shown my tickets, my proof as a government employee , all my family members are setteled in india .
I showed around 5000 CAD in my savings account & 20000 CAD as fixed deposit , mutual funds.

I have no traveling history in my passport.

Kindly let me know what should I do to get my visa approve and can I apply for visa now as I need to visit her in March.

1. CAD 5,000 is too low to cover the cost of your trip including the airfare.

2. Did you mention that you are visiting your girlfriend?

1. I already booked my flight tickets both departure and arrival and I have attached the same with my documents. What should be minimum amount that I should show in my savings account , as I usually keep my money invested in mutual funds or my provident fund (which I can withdraw at any point of time).

2. No I did not mentioned that she is my girlfriend I mentioned her only as an old friend and old colleague (we both met when we were in IT company) .She has now moved to Canada to pursue her MS last year on student visa & I am a serving officer of armed forces(a government employee).

I have submitted my cover letter , IMM5257E,IMM5257 SCHEDULE 1, Air tickets iternity , invitation letter from my girlfriend, bank statements last six months and salary slips , ITR of last two years , No obection certificate from my organization , Family information form , passport copy ,original passport , photograph in required format .

5. Yes ,my bank balance + financial investments matches my declared income and tax returns.

Kindly help me what should I do to get my visa approve. Shall I file again as a tourist visa with hotel bookings or is their any way to challenge the decision of visa officer.
I thought being a defense personal and a central government employee I will get my visa approve easily as I need to report to my new unit in month of April .
What I can do about my travel history should I mention my visits to Indonesia and srilanka as it is not in my passport also as I have not travelled at all with my passport It decreases my chances of getting a visa , so how can I overcome this?

Kindly help me as my departure date is 03 mar 19.

Tickets don't assure a TRV approval. It is not advisable to book tickets before visas are granted.

The maximum possible funds earned through your salary or financial investments.... not borrowed from anyone.... and must match your income tax returns.

Do you have credit cards (not debit cards) with good spending limits and low dues?

No, you cannot withdraw the money invested in their mutual funds or your PF until a certain period of time has passed.

Also, it would seem unusual if someone needs to liquidate their financial investments/pension funds to pay for their visit abroad.

Also, the visa officer was likely to question why would you as a first-time traveler spend a significant amount from your CAD 5,000 bank balance for an 8-days' visit?

The visa officer probably read between the lines and figured out your relationship especially since it your first visit abroad.


I am a serving officer of armed forces(a government employee).
This does not help for your TRV application. You're probably at a junior level in the armed forces and/or have not served at border posts otherwise there was a possibility that your application would be scrutinized for background checks as well.



3. Reason for rejection family ties in Canada and in country of residence
I'm pretty sure this refusal reason was because the visa officer figured out your relationship.

This is a generic refusal reason. There's nothing much you can do to change it at this point in time.

Are they dependent on you financially and for their well being? If yes, can you prove it? For example, they live with you and you pay the rent.... or you pay their medical expenses.... or they benefit because you are serving in the armed forces?

Don't book any hotels. It would indicate a red flag as it is a significant change from wanting to stay with your girlfriend to staying in hotels.

Quite honestly, I don't think this was an incorrect refusal. You have not demonstrated adequate ties to India to ensure you will return after a short visit.

Did you include any documents/evidence to show that there are serious consequences if you do not report by XX date?
Are you being promoted? Or have to take on new responsibilities?
Will you lose any benefits or pension/gratuity if you do not complete a specified number of years of service? If yes, do you have evidence for this?
Do you have to attend training before the new posting?

There's nothing you can do about your travel history. You must, however, prepare a detailed day-by-day visit itinerary for sightseeing, activities, etc. and prove you have the funds to pay for this with your own money + pay for airfare (you can highlight that your tickets are already paid for. BTW hope you paid for the tickets).

Do you have any other compelling personal or professional reasons to return to India after your visit?

I mentioned in my SOP that I will return to my country, an I attached my acceptance letter even the invoices for the university fees.! And there was a question in the questionnaire if you have relatives in Canada I answered yes also in family information I mentioned my sister live in Canada !! I want to re-apply.. is there any solution for my matter or any advice?and how to avoid these reasons?and is there any chance to be accepted when I apply a new application?

You need to provide your full profile.

Because your sister is in Canada, this weakens your application and makes IRCC concerned you have plans to come here long term.

It also sounds like you are currently living in a country where you only have temporary status (i.e. not your home country). This makes it more difficult to be accepted as well.

If you want to reapply, you'll need to show stronger ties to your home country to prove you have no plans on remaining in Canada long term.

Hi

I have been noticing that a lot of visa are getting rejected of siblings of PRs. I also want to apply for my sister and little confused that having sibling in Canada is a positive thing or it has negative effect on the application.

If I did that, will it work? And in new application I mustn’t mention that I have sister in Canada?

Not sure what questions are on the form but if there is a question that specifically asks about siblings and where they reside then I would tell the truth. If you withhold information and get caught you could be banned for 5 years for misrepresentation.

honestly im not familiar with student visas, but you are on the visitors section of the forum, if you post your queries in the students section you may get better advice. It is the forum right above this forum on the main page.

I just had an almost exact situation, this is my second refusal, and for the same reason, i.e my family ties in Canada and purpose of study. I’ve tried using enough property documents and a family business to show I have stronger ties to my home country, but it didn’t work for my second application, and now I don’t know what to do. Maybe I should just give up on this.

For the first reason they do not believe you will leave Canada as either you have family here they think you will just stay with. Or you do not have much immediate family in your home country to ensure you will return. What family do you have in Canada vs your home country?

For the second point there is not much you can do about it, they feel you come from a country that does not have good employment and that you are a risk to overstay in Canada. Others with your profile may have done the same.
That leads into the third reason, either you are not employed in your country or it is a job you will easily leave to overstay in Canada. What is your job?

What was your purpose of visiting Canada? what ties do you have to your home country?

thanks for your reply i really appreciate. as for the first reason i do not have any family member in Canada all my family member are here with me in my home country Nigeria. also i seven siblings and am the last in my family.

for the third reason, am applying for study visa. I got admission to study post graduate diploma in cyber security and computer forensics. I have six years working experience as a network engineer/ information security analyst in a telecom firm. I also attached my leave letter in my application. i also stated in my letter of intent that i will be leaving Canada once my studies are over to continue with my present job which i will be promoted afterwards.
