Brief background about my case. Ive been in a same sex relationship with my partner for 2 years and counting. I am married but separated from my husband since 2012. My husband lives in the US since 2011 up to this very day. Divorce is not allowed in the Philippines and Annulment is costly and lengthy process.
We arent too worried about proving thegenuineness of our relationship because we have kept all our proofs like remittances slip, receipts when she sent packages from canada, her making me as one of her beneficiaries on her health card, statements from both of our families, airline and itinerary records, travel receipts with both of our names on it, her closeness to my kids including their conversations, call logs/records, we will be applying for a joint bank account this December when she visits me again, our conversations and letters since day 1 of our relationship, just to name a few.
Are we qualified for conjugal sponsorship? I am married and same sex relationship is not allowed here in the Philippines.
I will be applying for a TRV this November or December hoping I could get approved but the fact i am currently unemployed or have no business here in Ph to prove my strong ties, most likely I will get declined. I just want to prove myself that I tried any possible option for me to visit my partner.
Shes coming here to visit me on December and will return back to Canada on February. If i get approved, my plan is to come with her on February.
If i get denied, can I use it as a proof that we have an immigration barrier preventing us to be together? If the immigration officer, asks my partner why cant she come live here in Philippines, simply because I am still married and that is considered adultery.
Please can you give insights about our plan? Are we taking the right path?
