Hi All,

I would like to leave a long post for future applicants that might be in same situation as me.

AOR - 10th Nov., 2018
COPR - 5th June, 2019

Nationality - New Zealand citizen residing in Australia

I processed my application through a lawyer in Canada so most of the blunders below are not my fault even though I have to take ownership of these as I was supposed to double check everything and not just leave it all to him.

1) On 10th Nov. (a day after submitting my application) I found out (through Canadavisa.com) that I had submitted incorrect PCC for Australia.

I had uploaded Australian Federal Police Clearance obtained using the ‘purpose of reason’ as “33 – Immigration/Citizenship – for supply to the Department of Immigration and Border Protection” but after going through Canadavisaforum.com I realised the correct ‘purpose of reason’ required by IRCC is “35 – Overseas Employment/visas – for supply to a country other than Australia”. Straight away I requested new PCC, requested Australian Federal Police Dept. to expedite my request. Got it in 3 days and raised a CSE to upload the correct PCCs on 15th Nov. 2018. I was scared for next 30 days as R10 check happens in about 30-35 days post AOR and most people get rejections for incorrect documents (mostly incorrect PCCs) at this stage.

2) Cleared MEP on 11th Dec. 2018 and at the same time received an ADR to submit Mexican Police Clearance. I have to mention here I was asked for Mexican Police Clearance during my initial upload of documents as well but Mexico only issues PCCs if you have a request letter from IRCC. So in the place holder for Mexican Police Clearance I had uploaded a document stating I am unable to obtain PCC without IRCC request letter. So they sent that letter on 11th Dec., 2018. For Mexico police clearance there is 2 ways of obtaining it – through IRCC consulate in Mexico (takes about 60 days for entire process) or find a local lawyer that will obtain on your behalf. I submitted through both ways – Sent completed application to IRCC Mexico for PCC and also applied through lawyer. It took me a month to find a lawyer that understood English. Anyways lawyer took 11 days and I submitted the PCC at the end of Jan, 2019.

3) Ordered Notes on 2nd Feb. 2019. On 6th Feb. 2019, called IRCC to confirm if my Mexico PCC has been attached. The agent was super nice and told me my eligibility is ‘NOT MET’ due to NOC mismatch. It was a shock to me. Anyways I went back to my application, checked all the forms I had submitted and found out 2 major mistakes. 1st in my address history I had put in incorrect year of stay in Mexico. I was only in Mexico for 4 days but by mistake chose wrong year so my stay became 1 year and 4 days hence the stupid request for Mexican PCC. 2nd big blunder was choosing NOC code 2281 as opposed to 2282(which is my correct NOC). So I wrote a very detailed CSE requesting a NOC rectification and also address rectification. Even though it was my lawyer that did all the mistakes, I had to take ownership and fix those.

A week after I found out about these blunders, I fired my lawyer.

Feb. end I received my first set of GCMS notes and as per last notes by Case Processing Agent - ----------------------- Ml3

SUMMARY NOTES: CLIENT DID NOT MEET MEC AS THEY DID NOT PROVIDE ENOUGH EVIDENCE OF ATLEAST 1 YEAR WORK EXPERIENCE IN THE REQUIRED PRIMARY NOC. PRIMARY NOC ON APPLICATION IS 2281 - COMPUTER NETWORK TECHNICIANS AND ALL OF PA'S WORK EXPERIENCE IS IN NOC 2282- USER SUPPORT TECHNICIANS.

A11.2: NOT MET

It was just a waiting game after this until end of March, 2019 when my file moved to local VO in a mass file movement that happened.
I ordered notes End of March’19 – Still have not received them.
Re-ordered notes mid-May’19 – still have not received them.

Lessons Learnt:

Never use a lawyer but If you do never ever rely on them solely.

Check your application at least 10 times and always get a second set of eyes to proof read everything.

Very important – Start calling up IRCC around 3rd month mark. Order GCMS notes by end of 3rd month. PLEASE DO NOT , I repeat, DO NOT LISTEN TO ANYONE that tells you not to order notes as it has negative impact on your application. It is all bull****. Just imagine IRCC rejects your file for ordering notes, you take IRCC to court- How stupid would IRCC look in court…Just think logically and don’t listen to idiotic advice.

When I got Eligibility not met everyone started discouraging me, saying it is sure shot refusal. I didn’t give up because I knew even though I did commit silly mistakes, I had sent through CSEs requesting rectifications. So any agent/lawyer/person tells you not to raise CSE until IRCC asks for it, kick him/her out of the door before it is too late. Send CSEs regularly….

We created a Whatsapp group for ENM (as we called it) and supported each other positively so do talk to each other, lift each other’s spirits high. As I always said and will keep saying it “You will get there in the end, some sooner others bit later”.

All the best everyone. See you all on the other side……

I am more than happy to help anyone in similar situation to mine but please do not ask me to match up your NOCs…lol….
Congratulations.. Happy for you
Please advise what have you written for them as I am having same issue.
Thank you

Hey.. I think I'm in a similar situation as you were. I made the big mistake of changing my application's primary NOC code from 2173 to 2174 just before submitting it, while my job which grants me the 1 year continuous work experience requirement for FSW was still left as NOC 2173. I received my GCMS notes yesterday and found that they calculated my CRS score above the cutoff for my draw but I'm still ineligible because of this NOC mismatch (no 1 year experience under the primary NOC). I sent them a follow up LOE about a month ago now, detailing this mistake and that the primary NOC should be reconsidered as what was originally selected.. Would this suffice? Is this quite similar to your situation? Any chances of this working out? I'd really appreciate your advice on this!

Best regards

As I said in private message - It might work depending on Visa officer....I sent multiple CSE's and they considered 1 of them to rectify my NOC code but then again it depends what mood is visa officer in....I would recommend write up another CSE asking if the Visa officer has considered your request for NOC rectification....and see what they say

@NZ_ozzie

Hi need your help.

I have made a mistake by requesting my previous employer to write my NOC code on my employment letter. That NOC code 2151 was as per my designation .

Now the thing is my duties match NOC 2251. So my question is if I fill in the right NOC (the corrected one) in express entry profile and mention in LOE that I made a mistake of requesting my employer to write the NOC code based on my designation and request CIC to avoid it as I doesn't match with my duties, do you think it can be any problematic?

I know NOC code wasn't needed on employment letter. But getting letter again from my ex-boss is extremely difficult.

Do you think VO can actually relate that it was a genuine mistake as the NOC code mentioned on employment letter was right as per my designation? Which now I know is wrong way to chose NOC :(

Please suggest if you think LOE will suffice in my case.

Can anyone please advise me.

I have 10+ years experience as a Lawyer (NOC 4112), but changed it in Express Entry profile to Paralegal (NOC 4211) in order to submit an application for Saskatchewan Express Entry since NOC 4112 is ineligible.

Apart from reference letter, they do ask for another 3 documents to prove your work history and 1 of the documents must be government issued. Even though I may be able to have paralegal duties written in a reference letter, my job title will state Lawyer in all the documents.

On top of that I do have Master's Degree in Commercial Law, while Paralegals most of the time do not require university degree.

I am now considering not to submit any documents and wait for my invitation to expire and not to proceed with this province. It is a big risk and I am worried I may end up being banned from applying to Canada PR for several years.

Your advice is highly appreciated.

I think you can withdraw it and apply with the correct NOC code....if later on immigration officer (I doubt they would check first profile but just in case) asks you for a justification, just advise you withdrew as it was incorrect NOC.....

The main problem is I cannot apply under the correct NOC since it is excluded. I sed the different one since it is closely related to what I do.

Basically I downgraded my NOC from Lawyer to Legal Assistant.

Similarly if a Doctor would have applied as Nurse for example.

Well as long as you can justify your job duties and responsibilities as Legal Assistant then you should be good....If not then don't risk it...Try finding other ways to increase your scores....

Well, the only document where my job duties will be stated is a reference letter from my employer. So, it should be fine.

As for 3 supporting documents I requested two letters from various government bodies and if I receive them they will merely state that I was working as an Associate/Lawyer for a certain period of time for my employer without stating my job duties.

Than I will take a printout from online government system where it will show that I have been working for 7 years as Associate/Lawyer.

And lastly I will ask a bank to provide me a letter stating that for a certain period of time (it will be less than my work experience) I was getting my salary from my current employer.

As I understand the main document is a letter from your employer. The other documents are supporting ones and they do not necessary need to cover the same work experience you are claiming.

So, as I see it if my reference letter states that I have 10 years work experience and describes my duties that is what they need. If supporting documents will be for lesser period that should be fine.

Hi everyone.
I have a question. I have 4 duties mentioned on my employment letter and all 4 match the NOC code. But NOC code has total number of 7 duties given. So basically only 4 out of 7 duties match. Can it be a problem?

I read on somewhere on this forum that the match has to be 80%. So, in your case the match is 57%. Thus try and add the 2 out of the remaining 3 job duties if possible.

As I udnerstand the job duties are the main thing they look for and not the job title.

Thanks for your response. That's the main point of confusion that many others on this forum say that 60 percent match would be fine.

The thing is that I have already taken the reference letter twice from my ex-employer. Previously i had only 3 points on it. I can add nothing more from rest 3 points.
