Dear Madam/Sir!!!
It is hereby requested to inform me about the Criminal Inadmissibility to Canada if a person gets into a normal fight with a relative and file Police Cases against one another and then take back the Cases written after being settled.

I am Ali from Pakistan. Sixth Months ago, I and my Cousin fought one another on the issue of Land and then we went to Police Station to complain against each other. And Police took the case and filed the Complaint/FIR under Section Crpc 107. After the next two days, we settled down and took back our cases written against each other.
Further explanation is that, spent 13 hours in Jail (Lock Up) of Police Station before appearing to Judge. After that, there was nothing but reconciliation between us.

But now, I am worried about my Criminality Background check. My Questions are;

1) Am I eligible to apply for Canada Immigration?
2) If Yes, Do I need to mention this ( Issue ) in the Immigration form?
3) How Canada Embassy or Consulate check the Criminal Background?

I think you should approach this scenario in 3 steps:
1) obtain the PCC certificate and determine if the report really indicates any criminal history against you.
2) if PCC indicates, as the case was withdrawn, try to see if you can get it rescinded from the records on the ground that the case was withdrawn.
3) if that also can't be done, they you should approach a Canadian immigration lawyer ( not consultant) to have you scenario reviewed and give you feedback if you can still apply for PR or not.

Hello
Thank you for your positive reply.
The think is I have PCC in my hand and there is nothing mentioned about the case in PCC and it(PCC)stated the I have done nothing adverse in my life.
So,
1) Am I eligible now?
2) how to contact to immigration lawyers? If you have any idea kindly share it to me.
3) I have PCC that stated me clean and clear of any offenses but still do I need to mention the incident in application form?

Kind regards.

1) If you already got PCC stating there is no adverse report on you, then cheer up. You are not going to get rejected for this reason.
2) I think you should check in this forum. I have not personally used any lawyer, so can't recommend one. But if your PC clears you off any crime, I don't think you will need one. These forum can help you with all your questions.
3) I think you should mention in your application and explain in Letter of explanation that the complaint was withdrawn.

I am sure there are others in the forum who might have similar situation and they can probably guide you, how they handled.

Actually i am worried about one statement that is written in a complain agianst me which was possession of pistol with me. I assure you that is false but the police considered this because of political pressure & this particular line in my complain bother me all of the time. But again which was a good thing that we wrote a concealation letter in Police station that we are settled and withdrawn our cases.

So, whats your opinion now?

And agian. Thank you so much for your time. Have a nice day : ))

Your PCC already cleared you. So do not worry.

You will be asked in statutory questions section in PR application (not express entry profile) were you ever jailed and you can explain that you were in police custody for 13 hrs due to a complaint by your cousin for fighting with him for land dispute. Later on we reconciled and the matter was withdrawn.

No need to provide complaint details in the explanation.

I personally think that your application might take time for processing but won't have rejection due to this. So don't worry.
