Exemption to section A11.2: candidates whose birthday occurs after they receive an ITA
An applicant may have a birthday after they receive an ITA but before they submit their e-APR. Their change in age may lower their CRS score below the lowest score in the round of invitations. It may also result in the applicant no longer meeting the minimum requirements of the FSWC and, consequently, no longer meeting the MEC, resulting in a refusal based on section A11.2.

When a change in age results in the candidate no longer meeting the MEC or having their recalculated CRS points score fall below the lowest points score in that round of invitations, officers should consider applying the public policy to exempt applicants for permanent residence from certain age-based requirements between invitation to apply and application, based on section A25.2. This consideration can result in an exemption from the refusal of an application under section A11.2.

This public policy also grants an exemption to applicants who may be refused for failing to meet FSWC program requirements when their birthday occurs between the ITA and e-APR.
The text that concerns me is -
This consideration can result in an exemption from the refusal of an application under section A11.2.

"can" :(

Please add me @444 ☹ (today is my birthday I was at 449).
You're added to internal tracker as well as blessings too.

First of all, a very Happy birthday to you. Secondly, I know you must be feeling sad due to -5 points but never lose hopes in life.

Be strong always and figure out, if is there any chance to enhance your score? (it can be IELTS, re-sending degree for evaluation, learning french or any other factor). Be proactive and keep moving!!

Remember that It's not over until you WIN !!

CIC has it documented on website that after getting ITA, if applicant's birthday falls then officer is advised to ignore the reduction of 5 pts and use the score at the time of ITA as final.
thts good... I wasn't aware abt this... Will bring smile to many faces...

For the first one, it would be NOC 2175. As far as will it count, honestly I don’t know. The VO has to be convinced thats all that matters. The NOC page clearly lists the duties and the requirements, so any information other than that may be unreliable unless confirmed by someone who has gone through the same situation. As far as I know, NOC is used to claim your primary occupation. One that you would base your application for permanent residence and use in Canada should you immigrate.

http://noc.esdc.gc.ca/English/noc/Profile.aspx?val=2&val1=2175&ver=16

Employment requirements
  • A bachelor's degree, usually in computer science, communications or business or completion of a college program in computer science, graphic arts, Web design or business is required.
  • Experience as a computer programmer or graphic designer is usually required.
The second one, it would be NOC 3121. Looks like you can count the experience once you have graduated and started working in 2018. I’d like to add a side note, not sure if optometrist is a job that requires licensing in Canada but I’d imagine so.

http://noc.esdc.gc.ca/English/noc/ProfileQuickSearch.aspx?val=3&val1=3121&ver=16&val65=Optometrist

Employment requirements

  • Three years of university undergraduate studies in sciences and a four- to five-year university program in optometry are required.
  • Licensing by the provincial or territorial regulatory governing body is required.
Thanks for the research :)

I did speak to a friend who had a degree in Arts but ended up working for a software company as a mobile app developer and recently moved to Canada. So, by not having a degree in Computers is not much of a criteria for VO to accept the job experience.

Yes, Optometrists requires licensure to practice in Canada, but to become eligible to practice Optometry, one needs to do a residency for which the person needs to be a PR or citizen. My Optometry degree has been positively evaluated as a professional degree by WES, which shouldn't be a problem.

However, my concern is regarding my time as a developer, will it be counted? Though I was a freelancer but had formed a registered a private limited company to save on taxes, the experience was gained while I was pursuing my education.

Welcome my friend, maybe someone in this forum who knows a bit more can chime in on the discussion?

Now as a freelancer, I’m assuming you can prove that you’re working on fulltime basis? Your income as a developer, etc.

I am maxed out on IELTS. Now I have two options left..

1. I redo my ECA evaluation through IQAS (because WES gave me 4 yrs bachelors and 1 yr Post graduation diploma for my Masters degree) because I have heard that IQAS gives masters credential for M.Sc. BUT it takes 4-5 months - If this happens my score will shoot up-to 451.

2. Will tell my spouse to reappear IELTS .. I might improve 3-4 points more.
Yes, fight for those points!

When I was a developer, what I did was I incorporated a company of whose I was a director along with my brother [my brother is a minority stake holder of the company], by law there has to be two people for the formation of a company, in India, hence, my brother was a director on paper with 10% stake.

Anyway, I was a freelancer but instead of taking the monies into my personal account, I would issue invoices in the name of the company and take the money into my company account. I had no employee, but would keep an intern on temporary basis from time to time, to put off some load from me. Anyway, why I did that? To save on taxes. which is what most people, around the world, do and is legal. I have all the proves that it was my business like share holders certificate, income tax returns, Ministry of Corporate Filings, bank statements of the company with my name on it, portfolio, work orders from clients, payments by clients.

Hi All,
I am a newbie. Just wanted to know if anyone tried increasing scores through job offer? Is is possible to apply jobs in Canada by any means while u r in ur home country n don't have PR.
