Hi there. I know similar topics have been posted many times before, I have spent a couple of hours looking over previous posts, but they either don't fit my situation exactly or are really old/possibly outdated posts.

Basically I am visiting my partner in Canada on a visitor visa, I am from the USA. We have plans to get married, but we have found out that we don't have quite enough time to get married then submit our spousal sponsorship application and ask for a visa extension as well (as far as I know, it seems really tight and sort of unrealistic at the moment to do it all, the marriage process by itself takes about a month in Quebec not including the wait for the marriage certificate.)

I understand what implied status is but I would like to avoid relying on that if possible so I want to get this out of the way while there is still enough time to hear back from someone within my 6 month visitor period.

So my question is, three months into my 6 month visit, is is possible to request a visitor visa extension without actually being married yet? Can we request an extension for another 6 months while saying that we plan on getting married soon and we need more time to organize spousal sponsorship paperwork?

Or... Should we get married first then submit a request for an extension without the marriage certificate and just include receipts for the notary and other fees we're paying?

And lastly, is it possible to pay spousal sponsorship fees upfront without submitting the paperwork just to show that we are 100% serious about going through this process?

I am hoping to find someone who has been in a similar situation and can shed some light or offer advice. Again, I am not here as a student and I am not working in Canada, I am just a visitor. Thank you very much in advance, all of this is so new to us and any help is always greatly appreciated.

Implied Status is valid and legal status.

If you apply for an extension too early, it has a higher chance of refusal. Wait until you within 30 days of expiry.

You can request an extension before marrying. Show proof of funds and explain that you are marrying and applying for common-law. You can pay the full $1040 PR fees and include the receipt in the extension app.

Hi, a bit of a late reply but my husband and I are now starting to get ready for our application and visa extension. I was hoping you could help clear up something for me regarding proof of financial support.

I am an American employed by a US company and I am working at a distance online, I have requested a letter from my employer stating that I am working for them but I would also like to include a letter from my father saying he will support me financially while I am here as well and that in the case of visitor extension rejection, that I will go home and live with him.

So my question is, can my father simply hand write a letter on normal paper stating that he will do these things, or does this need to be a legal document? Any advice on this is appreciated, thank you in advance.

Thank you for the simple answer. I'll have my dad write up a letter soon. I'll probably also have him sent a few paycheck stubs to show he can support me if needed.

Final question for now, if you feel kind enough to help out again lol... Do you think it's likely that my visitor visa would be accepted if we simply say that we are now married and have plans for spousal sponsorship soon, without paying our spousal sponsorship application fees yet? We are waiting on our official marriage certificate and for my FBI background check to come in the mail. It's likely we will not have these things for another month.

Or... is there a way to pre-pay for the spousal sponsorship fees without submitting the paperwork yet? I'm sorry for all the questions, all of this weighs heavy on my mind and we are just trying to let me stay for another 6 months.

You can pay the PR fees as far ahead of time as you want. State in the extension app that you are applying for sponsorship and include the PR fee receipt.
