If your Dad is not coming and seperated from your Mom, you have to provide the Divorce certificate.

There isn't a "legal" separation/divorce document, then what would you do?

I am confused about the fees. If I sponsor both parents, shall I pay 1040 (Sponsor your parent) + 1040 (Include the spouse or partner of your parent)?

I only want to sponsor my mom with my 18 y/o sister. My dad abandoned us 15 years ago, moved to a different country and now has a new wife. Mom and dad are not divorced yet. My question is do i still have to count my dad as a dependent? If i count him my income will be insufficient for 2016. Is there any way to exclude him from the count? I’m not planning to sponsor him now or in the future. Is it okay if I don't put him in the dependant section of the forms? Would a letter explaining the situation be enough to satisfy the immigration officer? For my mom’s marital status, should I put Legally Separated? But I’m worried because they don’t have court documents to support that. I'm so worried it might get rejected if he's not included in family size. I'm so stressed!

I'm sorry that your mother was left in this situation. Ideally you'd seek a legal resolution to her situation in her home country, since it seems it's not possible to get a divorce. Some countries accept a divorce in absentia. If you can't find a legal solution in her home country (not uncommon in cases like hers), you need to write a letter explaining the situation and including it in your application. Nevertheless you should indicate that your mother is still married in the forms, but I don't think you should include your father as a dependant (as they are de facto separated, unfortunately it's not legally separated or divorced yet). Saying she's legally separated when she's not is misrepresenting your application, which when discovered will result in an application denial or lost of PR status/Citizenship for all of them if they get it granted later on (your mother and sister).

Since your case is sensitive, I would contact a real lawyer to get the best possible advice you can get. It might be a bit expensive now, but you don't want to put your family in a precarious situation in the future.

That's right, 1040 + 1040 = 2080 for both parents.

I know there will be a lot of variance from application to application, though, I am creating below list of things which are easy to miss after going through most of the responses on the forum.

- Dont forget to write Name and DOB at back of one of the photo.
- IMM5406 - Additional Family Information: Dont forget to write names in native language.
- EIMM5669 - Dont forget to Sign by Hand on this form.

Please feel free to add to this list as per your experience, may help someone before sending the application.

The problem with just one name on the passport, common in Indian passports:

I will be writing not applicable and explaining it in the explanation letter saying i had to write it because it was a mandatory and won't let the form validate otherwise. This is what i would do, but yeah i haven't had any direction from others on the forum regarding this issue.

what do you mention as family size in this application. do you count the applicants you are sponsoring?

No, only immediate family members. Below, inside the table I stated that the family size does not include the parent been sponsored.

Yes, co-signing will make that happen.

Your family size will include your parents, your spouses parents, your spouse, your dependents (if any), your parents' dependents (if any), you spouse's parents' dependents (if any), your spouse's dependents (if any, but if your have children together, they only count once).

Same thing for your spouse family size.
