International Student PGWP refusal

Hi,

I am Valantine. I did a two years program in Toronto. My PGWP was refused on grounds that I submitted my applications after the 90 days. I have gone back to my country India now.

I have my girlfriend living and studying in Toronto and will be getting her PGWP for three years now in a month or so.

I have a credit card of $1000 that needs to be payed off and closed. Apart from that I have payed everything in full and closed my account. I have a credit score of400. I am planning on going back to Toronto on visit visa and getting married to my girl as we were anyways having the plan. Plan is to do this and then apply for a open work permit after.

Could some one advise if this is legit and feasible? Or are there going to be any issue that’s needs to be sorted ? Please could some one respond elaborating the concern ?

If you can get into the country, it's theoretically feasible. However, you may only be eligible to apply for an OWP from outside Canada - I'm not sure.

When did you graduate and apply for the PGWP?

Do you already have a valid TRV? If you don't, given your previous stay and PGWP refusal, your chances of approval are lower.

If you can get to Canada and marry, she must have a NOC A, B or 0 job in order for you to qualify to apply for an OWP based on her PGWP.

I graduated 2018 July but I applied for my PGWP only by December as I travelled back to India etc I do not have a valid TRV as the study permit and the TRV expired together , she will be getting into an NOC B soon.

May I know why the chances of me getting approval are lower and getting approval for what ?

I want to get a visit visa now to go back and get married in Toronto and applying for an OWP after she is properly employed and this is may be in the next 1 year that I’m planning to do and not any time soon.

Please could you investigate a little bit answer.

What @canuck_in_uk was saying is that your chances for a TRV are lower since you do not currently have one and have had a PGWP refused. When you apply for a TRV, what will your purpose of visit be? Will you be declaring your fiancee in your application? Both of those aspects are things that will decrease your chance of getting a TRV to come back to Canada.

Hey! Honestly don’t know the entity responding. I’m only requesting if some one could look into this issue and provide me a valuable path to take it further.

So I get what your saying. In this case will it be ok if my fiancée comes to India gets married to me here and then applies for a spousal visa for me on my behalf and she being the orimar

Your fiancee has no permanent status in Canada, right? Just PGWP? You could get married in India and get a spousal visa, but it may take some time. That may be the better idea anyways, since Canada may doubt the authenticity of a marriage entered into in Canada between two Indians without traditional Indian customs, as it will look like a marriage for immigration purposes.

Is there a way I could appeal for my PGWP that got refused ?

No.

(technically, you can apply for judicial review to the Federal Court, but you have to allege that IRCC did something wrong in fact and law - you admitted you applied late, so no go.)

Also your 400 credit score would have gone down if you abandonned your credit card. If you plan on coming back to Canada you should be making plans to pay it off asap.
