Hi All,

My parents will take my son who is a minor to Canada and we are now trying to submit a visa application online. My father is the main applicant and he meets the question-" Is your family member currently, or will they be, living in Canada with a parent or legal guardian for their entire stay? " when adding my son to the application. What should we answer this question? If we answer NO, a custodianship declaration is required.

Your father i.e. the grandfather cannot apply for the minor child. Only one of the parents can apply on behalf of the minor child.

The parent must include consent letters from both parents + all other requisite documents of both parents + an authorization letter to allow the grandfather to take the minor child out of your home country from XX to XX dates

I started a new application for my son. But because I answered NO to the question - Are you currently, or will you be living in Canada with a parent or legal guardian for the entire period of your stay? a Custodianship Declaration (IMM5645) is still a required document. I don't know what I should do. Can I upload a parents authorization letter instead of IMM5645 to this section? Thank you.

As your son will not be traveling with you or his other parent, you will continue to get the IMM 5645 Custodian Declaration in the document checklist.

As your father is not his legal guardian, you cannot upload the authorization letter from you in lieu of the IMM 5645.

You may want to check the possibility of preparing an affidavit to assign temporary legal guardianship to your dad for specific duration of the visit. Not sure if this affidavit will be accepted by IRCC
