We are still not separated. I have few proofs against him and need more to get out of this message. Meanwhile, I want to secure my PR.

I consulted a lawyer who suggested that I should attach an affidavit explaining my situation under R4 of Canadian Constitution and request IRCC to change my spouse to non accompanying. If anyone can comment as to how correct is that and what be the impact on my application?

This has already been explained to you. You just need to change him to non-accompanying. You don't need an affidavit or to make any sort of request under the constitution.

Before you go this long probably unnecessary route, why not just inform CIC via a CSE that you're changing your spouse from accompanying to non accompanying?
