That's definitely not the way I would want to start but there is good news. Sooo many cases are being denied right now due to the genuineness reason. But many who appeal, win. It's almost as if they just want to see if your willing to fight for it all you need to do is exactly what you said.

This is your office, for NS applicants. I also wouldn't hire a lawyer until needed, if needed. It could take up to 2 years, BUT, after your case worker reviews got file, which will be sent over from cic after you apply, the may give you an ADR.

ADR, or Alternate Dispute Resolution is an informal process in which a Sponsor who is appealing the refusal of their partner’s application for permanent residence as a member of the family class to the Immigration Appeal Division [IAD] has an opportunity to sit down with a representative of the Minister of Immigration and attempt to persuade them they ought to consent to the appeal being allowed. If you can prove during the adr that your relationship is ligit, abd overcome the concerns, you will win, and not have to wait for a full hearing, which you will be entitled to, should you lose. Hold off on the lawyer, fax your forms and get the ball rolling. Appeal form, notice of decision, and reason for decision can be faxed to the number above. I'm really sorry you lost on such a day, but keep your head up and don't worry, it's not over :)
Thanks a lot. Do you know if I have to order the GCMS notes of if they automatically send them to me with the appeal. My husband said the VO didn't type anything in the notes and the refusal letter is vague.

They will send over for you. The IAD will contact them as soon as they receive your appeal form. It's called a blue book" or something, I can't remember. But they will send you a copy as well.

Does anyone know if you are allowed to say the visa officer lied in the hearing or will your lawyer tell you not to go there. At least, will they let you say I didn't say that. Do the judges automatically believe the visa officers?

I think it definitely depends on the judge, and which party has evidence to back up what they are saying. You will most definitely have a chance to defend yourself. But if you have hired a lawyer, they'll do the talking for you depending on your case! You may not even need a full hearing You may be offered an adr is your case worker thinks you have a good shot of winning it:)

We submitted our application on the 31st December 2017. I was hoping if I can get some view points on case as well, since we have a unique case.
I am ethnically Indian but born and brought up in Hong Kong and now I am a Canadian, my wife is ethnically Indian but born and brought up in Hong Kong and studies and works there as well.Although we studied in the same Primary School and her parents knew my parents quite well, but it was not until September 2017 we started chatting on Instagram and fell in love.

Obviously, my wife and I had a lengthy discussion about if we were ready take this step and after discussing everything we were ready, and we decided to get married in my upcoming surprise trip in November 2017. After our decision we told our parents that I was coming and started planning our wedding, we had two Family gatherings, Wedding Ceremony, Temple prayers, Dinner party and a honeymoon and bunch of other trips around Hong Kong. Almost all the events above had up to 10 to 12 people attending it.I also planned a surprise proposal for her with the help of my friends at the Airport and we had bunch of other surprises along the way.I am planning another trip to visit her in May, due to her master’s education and work she can’t come and visit me but I will be going there for a month to see her again which I submitted the documents for.

At this point I already had a surprise trip planned to Hong Kong which my Mum was aware off, and after my wife told her mother about what my mother suggested, her mother took some time to explain it to her Dad and eventually they agreed.

  • Also submitted all the receipts we had gathered
  • Also submitted some Gift Cards with well wishes from coworkers

Our relationship 100% genuine and I want my wife to move here after her master’s is completed in the summer. Although this was not an arrange marriage, but our parents did have a huge say in it.



I just hope our application gets approved, any thoughts?

Since HK passport is visa exempted in Canada, you guys should have apply inland instead of outland. Anyway I assume this is your first marriage correct? If it is, then looked like the red flag is marrying too fast after you guys reconvene each other in Sep 2017. Do you still have any chat logs from IG or FB etc from Sep 2017?

Thank God finally my appeal allowed on the 13/12/18 after number of calls to the IAD case officer no good response so today 27/12/18 i got email from my lawyer that congratulations my appeal allowed. So what next now?

Well done. My hearing will be towards end of this month, wondering if you could give me a kind of heads up as per questions to expect. It was the same reason as yours (marriage not genuine). Well all I ll say is be real with ur answers and truthful too, Dont give picture of what u are not to urself in order to impress anybody.
The hearing is all day and at the end I glorify the special name of our God. No one believe it ll come out this way but again be positive, be focused and be strong leave the rest in Gods hand. Destiny can never be changed but only be delayed and most times for good.
Let your watch word be LORD HAVE YOUR WAY in all I do and set out to do. He will surely get it for you in Jesus mighty name... Amen

Hi Guys,

I am a Canadian citizen, my wife is European.

Now the tricky part is, my wife got herself a DUI in November of 2016 which means she is Inadmissible to come to Canada. She had to leave Canada shortly after and we decided to leave together and go live in London, UK until we can fix our situation in Canada.

Through a lawyer, we applied for Sponsorship and PR, along with ARC (Authorization to enter canada) and H&MC (humanitarian clause I think is the name).

About 6 month ago, our lawyer emailed us stating that our HMC and ARC were refused based on the fact that "Eventually my wife will become eligible for a pardon (in 2021) and can then reapply at that time"

Our lawyer told us that he believes the agent did a very bad decision and suggested we appeal it in court which we did and are now awaiting a Court date.

This is a very high level description, if needed I can go into the details.

Now what I would like to know is, am I wasting my money and time or is there any hope that this court date will allow us to move forward. It has been a very hard 2-3 years living outside of Canada and away from family and friend but we are still hopeful something can be done.

My husband and I just went through this. Denied due to criminality. A lawyer should have known first hand she would be denied. What we were told from the IAD office, and from the gcms notes, the only way to over come Inadmissibilitu due to criminality is to apple for a record suspension, which is an available option after 5 years I believe it is. You can get another option from a more seasoned member here, but from my own personal experience, and won't win Abd it sounds like the lawyer is just our for more money. He knew she would have been denied and allowed you to go with the application anyways:( anything to make a buck
