Hello. I made my first entry to Canada on 14 Aug 2015 and stayed there for 15 days to apply for the PR card. After that I got my PR card with a validity until November 2020. By this time I could not make to return back to Canada due to family problems (got married in home country and also became a father). I am planning to return to Canada in By November 2018. But by this time I have already spent more than 3 years in a row in my home country. Requesting advice regarding if I would face any difficulty in reentering to Canada and getting my PR renewed. Thanks.

You may be reported for not meeting the RO. If you are reported, you expect your PR status to be revoked and to be told to leave Canada. If you are not reported, you can stay for 2 continuous years to once again meet the RO. However, you will not be able to sponsor your family in that time and if they are unable to get TRVs to come to Canada, be prepared for a 3 year separation.

Thanks for the reply. Would be grateful if you could let me know if I would be able to sponsor my family from outside Canada or they can apply for travelling Visa during my stay in my home country. Besides, would like to know more about being reported, during my stay in Canada or outside Canada. Thanks.

You cannot sponsor your family for PR from outside of Canada. You can only sponsor your family once you have returned to Canada and lived in Canada for 2 years.

Yes - they can apply for a TRV from their home country. As said above, there is no guarantee if the TRV will be approved. If it is, they can travel to Canada as visitors and try to continue to extend their status for two years to remain in Canada until the time when you can sponsor them. During these two years, they will not qualify for health care coverage and your wife will not be able to work.

If you are reported, it will be when you are re-entering Canada.

For TRV can they apply on there own, or do they need information of PR holder in this case (mizanmrf).
Actually i am also trying to figure out what to do i am in same situation.
Thanks

Dear, Thanks for your valuable information. I was wondering if I'm not reported, why do I have to wait 2 years to sponsor my family.

Is there any chance that I will not be pushed back from the airport. And if I can re-enter how will I know that I have been reported.

If you are not in compliance with the Residency Obligations and you attempt to sponsor, your inadmissibility may be detected and your own PR status put at risk. You need to regain your compliance before starting sponsorship.
You WILL be permitted to enter Canada and you WILL know if you are reported.

If you sponsor your family and you don't meet the residency requirement, the sponsorship application will be refused and IRCC will move to revoke your PR status. That's why you need to wait two years.

Residency obligation is not a suggestion, it actually has consequences. 2 out of 5 years is very lenient.

Would be grateful if anyone has any suggestions to share.

You basically have two options. The first option is to re-enter Canada, hope you are not reported and then live in Canada for 2 years before you can sponsor your family. The second option is to renounce your PR status and then apply again from scratch, including your family as dependents in the application.

I was wondering if my spouse with the child needs to mention me in her application to get a travel visa. Also can she apply for Express Entry PR at her own with/without including me.

Yes she has to mention you are you are misrepresenting yourself and could end up with a ban. Yes you would need to be part of any PR application. If you qualify you should just renounce and apply again if you don't want to be separated.
