Hi guys im broken..!! I have applied a USA visitor visa yesterday with my wife and it was refused.!!! I have traveled USA before. My visa just got expired on july 2018. I had two 6 months stay in the USA before. So the officer asked me about those trips i told him that i was visiting, then he refused our visa this time.

So what do you think guys? Can we give another try? Please give me some advice..!! As my heart is broken now..!!!!

What were the refusal reasons?

It may not make sense to reapply immediately.

The officer:- why are yo going?
Me:- we are going to celebrate the new year eve and visiting the Statue of Liberty.
The officer:- why did you stay 6 months twice las time you visit USA?
Me:- I was visiting New York, Chicago. I have some distant relatives and my close friends there.
The officer:- when did you guys came to Canada?
Me :- 3 years
My wife :- August 2018.

The officer:- your visa is not approved!! You need more ties to Canada.

That’s it. No document checked!!!!

I would not reapply now. I would wait 8-12 months before reapplying until you have established stronger ties to Canada.

Six months is a long time to visit and it makes sense the officer had concerns about that.

If you are just going on vacation not sure why you are so upset. Unfortunately I don't this will be the first travel hurdle you will face as a protected person. Two 6 months stays is a very long time but many other protected people get refused.

It probably goes beyond the interview questions as your application is first checked and notes added to your file based on which he will ask you questions. If you did two consecutive six months stays in the US for visiting it is understandable that your file got flagged unless you provide strong reasons for that in your application. The visa officer must be satisfied that the reason provided is genuine (personal visit) and that your ties in Canada (work, school, house rental etc.) justify that you are unlikely to stay longer in the US.

You think i can reapply next Summer?

Yes - but since getting the visa, you have taken two six month trips to the US and have also claimed refugee status in Canada. The six month trips to the US were very very long and make it look like you are not a genuine tourist. You can certainly reapply next summer.

Would focus on establishing ties in Canada like jobs, getting a lease/mortgage, registering in school. Your wife has only been in Canada for 2 months so she has no ties to Canada.

Thank you for the reply. I understand that it was my mistake to stay in the USA for six months. But after coming to canada i have visited GERMANY, Austria CHINA,MALAYSIA,THAILAND, as a tourist. I never over stayed anywhere.one of my friend got his visa in the 2nd attempt today. You think i can try again now.?

Yes - you can certainly try.

Can only assume you got your hearing results and RTD last year. So much holiday travel is very unusual for Canadians and especially protected people in Canada. That may be a concern on top of the 6 month stays. Would also suggest you apply without your wife. She has just arrived and does not have strong ties to Canada. If approved you can try for her visa again.

I understand that this is a Canada visa forum, however since this thread already exists, I would appreciate if anyone can give me any comments on my chances of getting a US visit visa.

  • PR of Canada since January 2021
  • 1 US visit visa refusal in 2016 (because I applied within 1 month of coming in Canada as a student - no travel history at that time)
  • I have been to Germany on a Shengen visit visa for 1 day
  • I have been to United Kingdom on a transit visa for 1 day (outside the airport)
  • I don't have a house in Canada yet. Just a lease and a job.

What according to you are my chances for a US visit visa and what should I do to not get refused again. Any comments appreciated!

Edit: Let me add I am not a refugee.
