Create Thread: Hi any advice for my wife is 17 yrs and 6 month the visa office refuse to give visa they sent me apeal letter and am sending back to them so i want to know if they will reject my apeal

As she is above age of 16 so age doesn't matter here. Just to be on safe side add the afidavit signed by her parents.

Good Luck

It does in fact matter. IRCC will not process applications for spousal sponsorship applicants under 18. The applicant must be at least 18 years old at the time the application is received by IRCC.

hmm can he apply for TRV once she turn 18 than apply for inland sponsorship ?

If she want to try to come as a visitor, she can try to apply for TRV. With a refused spousal sponsorship application, her chance of getting a TRV is very slim.

"He" has no part to play in the TRV application.

Wait... so he is the applicant and she is the PR/Canadian?
Sorry! I got confused. I though it's the other way.

Zero point in appealing. You cannot sponsor someone as a spouse when they are still legally a child.

As a Canadian citizen you should have been aware that marrying a 16 year old (given it would take a while to apply and get denied) would be an issue. Curious whether you will continue having challenges with your marriage certificate given the laws in Canada and the fact that you are a Canadian citizen. On top of that what's the rush?

I am Canadian citizen

Doesn't matter. You cannot sponsor her until she is 18. If you appeal you will be refused again. As already stated, you need to wait until she is 18 and then submit a new application to sponsor her.

Well....the old dog learned something new today.....I wasn’t aware that applicants have to be at least 18.

It is legal in Canada to marry at 16 with parental consent, which it can be assumed they had in this situation, so there is no issue in regards to Canadian marriage laws.
