I have red your post and request your guidance for me as I just turned 18 last month and my parents could not complete residency obligations and they have applied for PR renewal in 2014 including me as child. Now what should I do. Should I apply immediately for PR renewal and start education in Canada. But my problem is I don't have any relatives there and my parents PR renewal is under review and looks like not going to be renewed. Please advise what to do. Also to apply independently which application should be used. Please leverage the learning. appreciated.

i have 1 more question please bare with me

i want to go for appeal because my marriage is in the month of december 2016

till them i will wait for the appeal process and if the decision is made i.e if i won i will go to canada as pr if my appeal is dismissed my husband will sponser me dependent visa.

so my question is

if the appeal process will not come to an end till this december can i withdraw my appeal application and so my husband can sponser me dependent visa?

Hey Priyabhee,
I have one query, Can you pls elaborate bit more when you say "you were removed from Canada when you were minor"..as in did your parents take you along or were you deported?

Priyabhee You are discussing this on a forum that can provide you with very limited help or advice, the correct way in your circumstances is you should seek proper legal services from a good immigration lawyer who is certified by the Law Society of Upper Canada as Specialists in Citizenship and Immigration Law. It can cost you a good amount of money so it depends on how serious and committed you are about this.

Hello everyone
I am the Canadian citizen, I am well settle in Canada since 9 years, my son is also Canadian citizen
My husband was outside of Canada for long time and his PR card is expired, he could not make 730 days in 5 years there were 2 main reason:
1) His mother was suffering from ALZHEIMER
2) He was perceiving PHD in electrical engineering
We applied on H&C grounds by giving detail explanation
Our PRTD request has been refused and they ask us to appeal, for that they may invite him to Canada for hearing? Do I have to consult immigration Lowers?

Please advise asap

get the appeal date from IAD then at the time when you will receive appearing letter , then use this letter and cross the border from USA by private vehicle. appear in court personally and even rejected, ask for another appeal. and keep staying in Canada. next appeal will be after 9 months or so, within this time period activate your SIN and get temporary PR card.

Hello,

I have an admit from SFU Burnaby and I applied for my Study permit visa to the Canadian Embassy on 1st of June and I received a mail from them today stating that since I was a Permanent resident holder as a minor in the year 2005 and due to family reasons I accompanied my parents back to India, I have been given another chance to renew it since I have officially not lost my Permanent resident status. They have asked me to either voluntarily give up my PR status and apply as a temporary resident or apply for Permanent resident travel document stating the reasons and providing proof of why I can back with my family back to India.

They have asked me to send them the required documents and if convinced they shall grant me my PR travel document and nothing has been mentioned if I can apply as a temporary resident. I am in a fix and I have no idea of what can be done. Either way, my admission is at stake. My PR card is for Ontario and my university is in British Columbia. If PR status granted can I immediately move to another province and finish up my two year Masters course and return back to Ontario and if not granted will renouncing my PR status right now affect my application in future.

I applied for prtd on nov 4th 2015 and got a decision from cic on 4th feb 2016
cic refused to give prtd as I didn't meet pr residency obligation in past 5 years and gave a notice for appeal

my story is I got pr in 2006 and I stayed in Canada only for 1 month and came back to india with my mom at the age of 13

as I was removed from Canada when I was minor and I have nothing in my hands to go back to Canada

MY friend has the same story he was removed from Canada at the age of 2 and applied after he reaching 18 years and got prtd without any rejected or appeal

the only difference between me and my frnd's case is I am 22 now and he was 18 when he applied for prtd which I think not considered and the rejection reason was only that I didn't meet residency obligation so its not related to age ..as we both didn't meet any obligation

I hv reason if they ask me y I didn't apply for prtd when I reach 18 ...when I was 17 I was forced to join bds in india because of financial reason as my dad couldn't affort for my studies in india ..so I was supposed to do my graduation in india till 2015 nov .

do you think they cosider this reason

so my appeal is I was removed from Canada when I was minor and as soon as I could make my own decision to come back to Canada and settle, I applied for prtd .

I wanted to know whats the appeal processing time?

please share your experience regarding my case..
help me if anything I can add to win appeal.
Any update? I have a similar situation.

In your case outcome of your H&C does not really matter. Even if your husband will now loose his PR, you can sponsor him back easily (and sometimes that is even a faster way, than long H&C process). The only reason why you could not sponsor him is if he was criminally inadmissible.
