Hello ,

My husband has overstayed, and we applied for inland spousal sponsership. Our application got returned due to missing police clearance. Can you please tell me how can we get one? our lawyer said its risky and we have already submitted file second time with letter of explanation. I am too worried . Please help.
Whatever country he's overstayed in for 6 months or longer, needs to get a police certificate from there, look at the CIC website for instructions

I was in same situation, but if you go their with your husband (together) and talk to them that we have to file for immigration, they will give you. They will be bit rude because Canadian Govt. give them hard instructions to avoid overstay of their citizens. They issue PC for me on third visit.

If they dont give you that clearance then you can ask for one letter , and get PC from Passport office in India.
I know its hard time, But you will figure it out. Do not listen Lawyers, they do fraud with people.

Thanks for your reply. But i think you applied for PCC after getting your AOR. Am i right? Because i checked your timeline and its says received AOR submitted PCC. Can we also get PCC before getting AOR? kindly advise.

When you send file , you dont need anything, you can send file without PCC then after 40 days , they will send you email which is AoR, when you link your file with cic account then they will ask you for PCC and you get 30 days. This is the time you will get PCC from Indian Consulate.

Yeah, thats the thing. We already did sent our file on may 24 but it was returned due to missing police clearance. We never received AOR because these days they need upfront pcc which we donot have. So we attached a letter of explanation stating that once we receive AOR, will send PCC. but still we got our file returned. Thanks.

If you are out of status when you apply for the OWP, you will not be granted your OWP until you receive AIP (approval in principle) for your PR application.

AIP is currently not being granted until very shortly before the application is finalized (10-11 months in) so you can expect to be out of status and unable to work for almost the entire application process
is the date count from when they receive it or aor (pr = owp). we applied june 22, status expired third week of july, we came back from holiday they let my husband in with proof of his application receipts, and we got aor aug 7

I think they will probably issue your husband's OWP at the normal 4 month timeframe since he was still in status when he applied.

Hie ..i wanted to ask you when they asked for pcc, does it show on your ECAS that they have requested document.. the thing is i havn't linked application yet, because we have representative and i cant link my file, i will cancel her later on. so in case they need pcc, how they will approach me or will it show on ECAS? thanks.

So I guess I am in the same boat as a lot of you. I sent in my app and OWP app before my status as a visitor expired. I wasn't aware that the PR app wouldn't give me implied status (my bad, I know) and thought everything was fine until I got my OWP application sent back to me about a month and a half later due to insufficient funds. Which mean that I was then out of status. By a little over a month. I was under the impression I was still fine until about a week ago when I found out my status had expired and now I am left with the option of leaving and coming back into canada, if they will let me back in at the boarder, and having visitor status again or staying here and not getting my OWP for another 4-6 months. Which sucks.

My husband and I decided that we would rather struggle a bit financially for a few months than risk me not being let back into Canada, even if those chances are slim. I think we would risk the chance if he had a passport but unfortunately he doesnt so he wouldn't be allowed to leave with me and then enter canada again with me.

It all sucks.

Anyways, my timelines are:

Date Received: April 30, 2018
AOR: June 2, 2018
OWP returned: June 28, 2018 (missing payment)
OWP resent/received (2nd time): July 3, 2018
OWP linked: August 17, 2018

Here's hoping I get my AIP a little sooner or for some reason they decide to grant me my OWP since its clearly not unheard of just... not a common occurrence.
