On May 23rd, I have applied for common-law sponsorship permanent residency application to Mississauga office. The application has been returned to me as it was incomplete due to: 1- lack of Iranian police certificate. 2- I forgot to sign one of the forms. I need to re-apply as soon I receive my original Iranian police certificate copy. My post graduate open work permit (PGOWP) expires on Aug 4th. Based on CIC website, I can stay 90 days after expiry of my PGOWP but I can't work.

My questions are:

1- What will be my status during 90 days after expiry of my PGOWP to re-apply for PR application?
2- Am I eligible to re-apply for PR application within Canada during this 90 days?
3- What will be the steps to proceed? Do I need status restoration if I apply for PR during 90 days after expiry of PGOWP?
4- What you would recommend?

1. Unless you apply for an extension, you will be in Canada illegally as of the date your PGWP expires. That 90 days is not permission to stay in Canada; it is a grace period where someone can apply to restore their status.

2. You can apply for PR but won't be eligible for the OWP.

3. Yes, you would need to apply for Restoration.

4. Apply to extend your status as a visitor before your PGWP expires. Do NOT go out of status.

When I am filling the form there are two option:

1- restore as visitor
2- extend as visitor

Which one should i check?

As long as you apply prior to the expiry of your permit, then it's extend your visit. If the permit expires, then you apply to restore status.

Extension. Restoration is for people in Canada without status.
