On any given day I get 20-30 messages in my inbox. I request everyone to post here, so that I can keep a track and answer, which helps everyone. If there is something personal, then only send me a PM. If you have sent me a PM, please re-send and I will revert back.

However, when you send me a PM, please also post here and tag me.
Sir i just got your detail from a member at this site. I have a little bit of confusion which you might be able to clear or maybe advise me.
I had applied for PR FSW in 2014 and my application packet was returned but i have lost the paper which came with it which included the reason why it was sent back. Nor i remember exactly what had happened.

These days i am applying for PR EE. And i received an ITA and the forms were asking have you applied before for PR and the UCI number and reason for return. Now i thought i should give them a call to find the reason but as you know i am in USA and call center is designed for Canadian residents so i conferenced in with my frend in canada and called IRCC. the agent asked me UCI number, DOB, And name and then asked me for a Local phone number and i hesitated as i was in USA but he asked are you in Canada sir,,, to which i said yes by mistake and then he asked me for address and phone number which i gave of my frends.. Thus after that i hung up as i thought he might put all this in my file if i complete the call. So now i am stuck and very much worried as i am in USA and i said i was in canada to the agents question. my question is will it impact my furture application, what do you advise in regards to this ??

Hello @legalfalcon,

Trust you are doing great?

I just noticed this page and I would really appreciate if you could help shed more light on my case and suggest the next line of action. I'ld appreciate everyone's input too.

My AOR is Aug 3rd, PNP. Sorry for the long message.

From the Assesments in my gcms notes, I could only make out that criminality only is passed for my spouse and I, security and eligibility is not started and info sharing is in progress.

It's a bit confusing though because there are parts of the notes that says eligibility is passed and info sharing for my spouse is complete.

The last email I got from LVO on the 18th of may says this;
"Thank you for your email.
Please note your file is awaiting review by a visa officer. Unfortunately, we are currently unable to advise when this review will take place due to the high volume of files, however, please rest assured that we will contact you as soon as the application has been reviewed or further documents are required. Please note every application is different and the processing time may differ from one file to the other.
We appreciate your patience during this process.

Yours sincerely,

Have you requested GCMS, that will immensely help you. Usually the special unit during eligibility is a fraud detection, where LVO officers will personally visit employer. I don't want to scare you, but if you request GCMS, you will know what exactly is happening.

Thank You @legalfalcon

I received GCMS notes early in June and there wasn't anything mentioned in them about this special unit thing. I am an outland FSW applicant. I am actually happy if they visit or contact my employer to verify my employment claims (I claimed points for my work with my previous employer, 2010 to 2013, I worked in a government office and they have all my employment records). At least that will help IRCC to clear my eligibility. My eligibility is still under review required.

Actually, at first, I thought the special unit means I am under security screening.

Thanks for your suggestion, I will order GCMS notes again.

Thank you so much for the detailed explanation.

1 & 2. When you say chronological order, do i order them according to the "start date" or the "end date". Eg: the latest end date on top and the oldest one below the table.

4. Removed all training and workshop certificates. Thank you. :) How about certificates/ diplomas for 3 - 6 months? Do I need to include or remove? I have not claimed any points for them.

7. With regard to this, isn't it "No". Coz the exact description is "Has (applicant name), and if applicable, (applicants name) family members taken any trips outside their country of origin or of residence in the last ten years (or since their 18th birthday if this was less than ten years ago). Include all trips: tourism, business, training, etc". It has a wording as "if applicable".

8. Isn't it "Yes" because I have stated two organizations in the personal history. Lions Club and a local Professional Association. This is in the description of Organizations, "List any organizations (name of applicant) has supported, been a member of or been associated with at any time. Include any political, social, youth or student organization, trade unions and professional associations."
Yes, the latest end date on top and the oldest one below the table.

No need to include the diplomas or certificates at all in education history, unless you have ECA for it and claimed for it. If when you obtained these diplomas, your full time status was a student, then mention this in personal history.

When they ask for family, it means your family, i.e., you, your spouse and any children. Not your parents or siblings. So answer accordingly.

You can answer yes, it will not matter.

Generous legalfacon and other Falcons,
Could you please help me in finding where my security is :

Activity/Sub activity: Biographic

New Value: Submit-delayed
Info Sharing: Complete "

Moreover, the first page of GCMS notes is as below:

Eligibility: PASSSED
CRIMINALITY: PASSED

Security: _____________ (Blank)
HIRV:______________

Is it regarding security screening?
I'll be grateful.
Sincerely,
Nasar
What is your AoR, and when was your Eligibility passed.

If it has been more than 2 months since you passed eligibility, then you may be in SS, but to conclusively say so, you will need to request CSIS and CBSA notes.

Hey @legalfalcon. Thanks for all your replies. Post my last request, I received a an intent of refusal letter from OINP where they mentioned the same thing: I need to show one year continuous employment in NOC 2171 (which was wrongly chosen by and informed them like 5 times already). This time I am planning to change my NOC to 2172 and will send them a screen shot. Do you think it's OK to do so. They have literally ignored all my requests to help me change the NOC and now I am left with no option.
If you have already transmitted your application to OINP, then even if you change it in your EE profile it will not matter. If you have transmitted your intent to change NOC, then it is at the discretion of the OINP immigration officer.

@legalfalcon,

What should I attach for the this, "You indicated you have another name. You must provide information on the use of this other name (such as a letter of explanation, legal documents of a name change, etc)"?

a) Would a same name affidavit, marriage certificate (original, translated with translation affidavit), the passport pages which shows the name before and after marriage be sufficient?
b) Do I need to mention in LOE regarding name differences in education and employment records with passport? Same name affidavit is sufficient?
a) yes. Only marriage certificate and explanation on LoE will do. Adding an affidavit, though not required, will be an overkill.
b) Yes.

A prior rejection is not because of criminality, fraud, misrepresentation or medicals, will have no impact. However, you will gave to state why the application was returned. If you do not remember, you can request GCMs notes for the prior application, and only your info, doB, and the year you filed the application will be sufficient.

If you do not remember anything, then explain it in LoE, but it is always better to know why the packet was returned.

@legalfalcon,

please at what point can i withdraw my application for PR?
You can withdraw the application at any point. Even after it is approved, you can withdraw it and surrender the CoPR.

For the purpose of fee:

If I withdraw my application, will I get a refund?
In most cases, you can only get a refund if you withdraw your application before we start processing it.

If we have already start processing your application, we can only refund:

  • the right of permanent residence fee (RPRF)
  • the right of citizenship fee
  • the open work permit fee (for Labor Market Impact Assessment (LMIA) exempt workers only)
  • the employer compliance fee (refunded to the employer), and
  • International Experience Canada (IEC) fees (See refunds for IEC)
You can request a refund online. If we started processing your application, submit your withdrawal request using our web form.

After you submit a request, we will contact you if we need more information and to update you on the status of your request.

I would recommend that you request updated GCMs notes to see what is going on. For eligibility 'special unit' refers to investigation unit which verifies the employers by calling or in person visits. However, since it is not very clear from the reply, as they are generic, you should request an updated GCMs notes and see.

Sir, Do you think what i said to the Canadian call center agent that i am in canada would have any impact. I thought if i dont say i am in canada he would not provide me further info. I didnt expect that he would ask for address and contact details inside canada. Now i gave my frends contact details and address who is in canada. Does this have an impact ? Will that be written on my previous file ?

Thanks for the reply @legalfalcon.

I think these notes shows my current status as I only just got them few days back, I requested for the notes about a month ago. Can I request for another already?

I was thinking I request for an update directly from LVO.
