Translation of documents
You must send the following for any document that is not in English or French, unless otherwise stated on your document checklist:

  • the English or French translation; and
  • an affidavit from the person who completed the translation (see below for details); and
  • a certified copy of the original document.
I am aware of these requirements. But the document checklist is asking for a photocopy, so my question is whether a photocopy of the above might suffice.

I am completing IMM 5768 Financial Evaluation Form and got confused. Hopefully you guys can help me.
-- Hubby is sponsoring his mom this year (dad passed away)
-- I am sponsoring my parents this year (mom and dad)
-- We are each other's co-signer.
-- no previous undertaking & no kid.

I am not sure how to complete Question 3 and Question 4. is this how we should complete them?

I have been selected for 2018 parents sponsorship application by IRCC, I will need to submit my application in next 60 days, I am Canadian Citizen,live in Canada for 12 years.

I have worked under a contract job (18month) and lived in Europe from June 2016 to Feb 2018, and filed my income return in CRA with overall amount of 92,000 CAD for 2016, and 95,000CAD for 2017 (European employer), I have received my NOA for 2016, and waiting for 2017 NOA now, my income on NOA for 2014 and 2015 (Canadian employer) were over 85,000CAD, according to IRCC, I need 55,000 CAD minimum income to sponsor my two parents, I am single status.

Since Feb 2018, I have lived and worked on consulting project between Canada and Europe, I may need to live and work in Europe for around 7 months in each of next two years.

Questions:

1) Is my European employment contract income 2016/ 2017 qualified as sources of income to meet IRCC requirement for my sponsorship application for parents?

2) Since I did not live/reside in Canada for 18 months in 2016 and 2017, but am now living in Canada, am I still qualified as sponsor for my parents as I had completely worked and lived in Canada before July 2016.

3) Can I live and work outside of Canada , or Can I use the future income from my work in Europe (My income will be from an contract employment in Europe, not in Canada) while IRCC processes my parent's application for my sponsorship in case IRCC ask me to provide 2018 or 2019's return for reconfirmation?

My intention is to completely move back to Canada once my parents are granted PR. THANKS!

According to the requirement, there is no mention of the minimum of days of physical present of the sponsor in Canada, provided that you are either Canadian or Permanent resident. There is however, requirement of, "live in Canada" (see the Guide: https://www.canada.ca/en/immigration-refugees-citizenship/services/application/application-forms-guides/guide-5772-application-sponsor-parents-grandparents.html#apply) so other people here may comment further on this?

As for the LICO, if I understand correctly and according to the guide (https://www.canada.ca/en/immigration-refugees-citizenship/services/application/application-forms-guides/guide-5772-application-sponsor-parents-grandparents.html#income), if you have NOC of 2015, 2016 and coming 2017 from CRA (and subsequently pay the due taxes on these income), your income are qualified to sponsor.
Your tricky situation is where those source of income coming from. However, I am thinking that if CRA issues you NOAs, that means they have accepted your return and therefore, acknowledge your income. Other people here may comment further!

For 2016/2017, did you have any Canadian income on line 150 of your tax return ? If not, then you do not qualify. It has to meet the minimum.

Not only do you need 3 consecutive years of Canadian income, but you also need to maintain that till your parents land as PR. Your income can be reviewed at any time after you submit the application, per the instruction guide.

If in 2016,2017, or 2018 you fail to meet the minimum (line 150 on income tax return), then you need to wait another 3 years (with a Canadian income that satisfies the minimum requirement).

Minimum Necessary Income requirement for sponsors of parents and grandparents
If you are sponsoring a parent or a grandparent, you must meet the minimum necessary income requirement for each of the three taxation years immediately preceding the date of your application. The minimum necessary income requirement is equal to the Low Income Cut-offs (LICOs) plus 30%, taking into account the number of family members for whom you are or will be financially responsible.
PS: you should've figured this stuff out before you filled out the lottery form. You had a month! If you do not qualify, you just wasted a lottery spot.

Edit: As @babybenz mentioned, you also need to be living in Canada to be able to sponsor.
In order to sponsor, you must…
  • be 18 years of age or older;
  • be a Canadian citizen, Registered Indian or permanent resident;
  • be sponsoring a member of the family Class;
  • live in Canada;
  • sign an undertaking promising to provide for the basic requirements of the person being sponsored;
  • sign an agreement with the person you are sponsoring that confirms that each of you understands your mutual obligations and responsibilities;
  • prove that you have sufficient income to provide the basic requirements for your family members in Canada as well as the persons included in your sponsorship undertaking. You may also have a co-signer.

Question for IMM 5768 (Financial Evaluation for parents )

Q1 : i dont have co-signer (means my wife is in school and she is not be co-signing undertaking ) do i need to answer 16 & 17
16. cosigner - statement of consent ?
17. cosigner - employment history ?

Q2 : EMPLOYMENT HISTORY - SPONSOR ( employment history 3 tax year ) point 14.
do we need to break it based on tax year or employment history ?
i mean - example
Jan 2018 to present -- xyz company -- Gross income ? ( for 3 months ? )
Jan 2017 to Dec 2017 -- xyz company -- Gross income ( full tax year )

if any one filled the form pls help me ?
I can't answer your Q1 since I have co-signer. But I could think if I don't, there is no need to fill those out. Refer to the guide for more?

Q2: My wife was unemployed (household job) for the first 3 months of the year, then worked for a Canadian company for 6 months and was again unemployed for the last 3 months of the year so there would be 3 different line on the form:
Jan - Mar: unemployed - $0.00
Apr - Sept: worked at ABC company - $12345
Oct - Dec: unemployed - $0.00
and provide the NOA showing that the entire year's income was $12345

There was a thread or a post here somewhere which quoted some text from the IRCC website indicating that income sources have to be Canadian. I'm unable to find it now.

In anycase, OP is living outside Canada, which makes him ineligible, correct ?

The thing is that the requirement says "live in Canada" and did not specify how many days? So in his situation, he was temporarily working in EU instead of living in EU and he could argue this?
Not sure if IRCC could pull up his entry/exit from BSCA to determine how long (how many days) that he must be present in Canada in order to be "Live in Canada"?

I read somewhere in the CRA website that, once you are PR or Canadian citizen, all of your income regardless of inside Canada or outside Canada must be declared in the return. This is regarding as "world income" and should be reported on line 150. When filing tax return, ones is reporting how much income ones make during that year and subsequently, paying (this is important) taxes on those income
So, in his case, I guess if he has been issued NOA by CRA, for 2015, 2016 and 2017 and the total amount is more than the required LICO, he is totally qualified as sponsor for his parents

Pretty sure that means you must be currently physically present (living) in Canada.

Can anyone confirm if we were required to identify Principal Applicant in "Interest to Sponsor Form" or just names of parents. want to make sure my application matches with interest to sponsor form.
I dont remember, if there was a field for this and if there was, whether I chose my mom or dad as Principal Applicant.

I printed a copy of my filled out Interest to Sponsor form. They only asked who the principal sponsor is. As for parents/grandparents, it only asks for their info, not who the principal applicant will be.

The rules state income must be earned from Canadian sources or while living in Canada to be eligible for LICO qualifying.

5.30. Financial requirements
Financial resources:
Financial resources must originate from Canadian sources for the following reasons:
• employment income abroad is not a reliable indicator of future or stable employment in Canada.
• CPC staff cannot easily verify if foreign income can be transferred to Canada.
• converting foreign income into Canadian dollars is resource-intensive.
• in cases of default, collection and litigation, it is easier to recover income from Canadian sources. For more information, see: Exceptions to the Canadian income rule, section 5.31.

5.31. Exceptions to Canadian income rule
The exceptions to the Canadian income rule are as follows:
• sponsors who commute from Canada to work in the U.S.A. can use their U.S. employment income provided it is declared as income on their Canadian income tax return;
• sponsors living in Canada who declare income from foreign sources on their Canadian tax returns, can use this foreign income to meet the financial requirements for sponsorship.

Discretionary approval of financial requirements is not possible


So technically since the visa officer will see your source of income in some years was from non-Canadian source, and earned while you weren't living in Canada, they would have grounds to reject the application based on this. Or, they may be satisfied since you claimed Canadian income tax returns for the whole amount. You can always apply and see what happens, but just be prepared for possible rejection.

Also you must be physically living inside Canada to submit the app, and until parents land as PR. If at any time during processing you move outside Canada and IRCC finds out, they would have grounds to reject the app since you wouldn't be meeting one of the main qualifying terms. Plus the income earned outside Canada would not count, so you may fail a future income test (which they usually do before approving the app to ensure continued compliance with LICO).
