Wife not accompanying to Canada

Hello All,

My wife and I do not live together for past couple of months. She is not willing to cooperate and move forward the PR process either.

1) Since I am married as per legal documents , what is the way out to file for PR without my wife.
2) Is it possible to apply as legally separated? If yes, what documents need to be furnished after I get ITA?

Thanks for a super prompt response. Since , the process of divorce / legal separation takes years in India , does the divorce petition filed in court work as valid proof to move forward with the application ?

the start of divorce proceedings can me used as proof but that does not guarantee that CIC will not request medical and PCC from your wife.

Hi, i submitted the attested divorce petition documents and status as separated. Sometime during my process I got the divorce and submitted the divorce related attested documents through CSE. PS, i have not received my PR as I'm stuck in security screening unfortunately. Just to add, CIC didn't ask for my wife' s medical, nor pcc

Thank you. I will only be able to provide the petition acknowledgement from the Court and not divorce decree. I hope that it will go through.
