Hi @lynncita

There are lot of people here on the forum with the same issue, try searching 'child medical custody' on the forum itself.

For your case I suggest.
1. If your partner has shared custody, paid maintenance or is paying maintenance, cic will insist on child's medical. If this is not the case with your spouse, he should provide documentation to prove he has no custody like he can provide divorce, custody papers.
2. He need to document all efforts in reaching out to her asking for medical like emails, phone calls, and also need to document his ex's denial for the same.
3. Prepare a letter of explanation giving out all details available for the child and explain the situation for not being able to provide the medical.

Ircc will come back if they need more info, but the fact is ircc does not want to exclude kids from medicals.
Best of luck

Theyll ask questions about your relationship and red flags they see in your app - did you order your notes to see what they are questioning? Theyll tell him on the spot if he was approved

What is your relationship history? Has he had previous marriages etc?

I did order the notes and have been doing that for the past 9 months of the whole process, however the notes didn't indicate anything specific as to why they wanted an interview, which is why i was unsure as to why he was requested to attend an interview.

Our relationship history: we got married 5 months after meeting each other. It took us a while to get this immigration process going due to financial issues, but i have traveled to DR many times to visit. As a matter of fact, my husband just came back from the interview and told me that the main concern was, "why we didn't have more pictures"

He wasn't approved on the spot. The offical told him that he would know the results in 2 weeks.

I'm not really sure what to make of it all and I'm kind of nervous.

Seems like they are looking into the 5 months and did he go with more evidence of your relationship? I dont know that visits justify much in their eyes (i really cant say as my husband lives here in canada). Im sure its positive. Did they keep his passport?

Yes he took plenty of evidence with him. Western union transfers, whatsapp screenshots, pictures, evidence of trips taken since we sent in our application , notarized letter from his family, phone call statements.

No, they did not keep his passport.

I finally got news from Mexico VO! They ask us a info we already sent: for example, copy of birth certificate of children (we actually sent original versions at first, now 8 months after they ask us copies..) Also, hubby had an accusation from 18 years ago and it appears on police record: a small offence which he have been found not guilty. Still, they are asking a tons of thing about that. Anybody went through this? I mean, it was only an accusation... and 18 years ago!

Also, they ask divorce certificate between him and the mother of children, which he never have been maried to (and we never wrote so in our application)... I'm wondering if this is a mistake from them or what..

If you have had similar experience, please share !

Thanks

I have a question which I haven't found answers on the forum as of yet - if anybody is aware, please redirect me to the post.

My husband has a daughter which is not accompanying him to Canada - she will stay with her birth mother. However, as we know, CIC requested the medical. In this situation, the birth mother is difficult and tries to do anything she can to make my husband's life complicated. She will not let the daughter have the medical examination. He has tried and asked her, but she refuses.

Is there anybody who has had this situation? Can I ask, if so, what information did you include? He has asked several times but she will stop him from seeing the child if he continues to ask. Is a letter of explanation sufficient in anybody else's experience? The daughter never lived with him, he has no legal custody - child always has lived with mother, he never lived with them. Any suggestions would be so helpful, just nervous that this will bog down the process.
This is a difficult situation. I've been through something a bit similar but still was different. I would suggest sending a letter from a lawyer to her and keep copy so that way you have proof you make everything in your power to get the children to the doctor. Explain in this letter why the governement ask for this and what are the objectives. It will probably delay your demand and you will have to sign a form that you will never ever be able to sponsor those children in the future.

Did you submit the 20 photos they asked for? Usually people have way more than this but they don't want you to submit more, so not sure why this would be a concern for most people. Why didn't they just ask you guys for more photos then?? My spouse has his interview on March 19 and our GCMS notes also did not indicate specifically any concerns, even though we are aware of our red flags. Maybe we both had the same officer doing the summary for the assessment of the relationship.

We are 13.5 months into processing and I'll be so upset if they don't tell him if he is approved or not on the 19th. Even if they don't approve him, I want to know, we have been in limbo without a decision for way too long!

I hope you hear something back from them before 2 weeks time and get a positive decision!

We submitted pictures. And, he also took as much evidence as he could to the interview.

My concern was that he was not approved on the spot and that the agent told him he would receive a response in 2 weeks time.

We are only 10 months into the process but I feel like it has been forever. I'm really hoping that the outcome is positive.
