Hi,

We are PR of Canada living in India. We have a child who was born in India and is not PR of Canada till now.

Is there any way I can apply PR from India. CIC says PR sponsor should be present in Canada to sponsor anyone.

Provide your suggestions.
 
No - it's not possible to apply for India. If you try, the application will be refused.

The person sponsoring must be physically in Canada when they submit the application and must remain in Canada while the application is processed.

Also note that at the time you apply to sponsor the child, you must meet the PR residency requirement. If you apply to sponsor and don't meet RO, CIC will refuse the application and also move to revoke your PR status.

I am thiking to move first and sponsor my child and by that time I would not have completed PR requirment. Is there a problem in doing this.

That is in fact a problem. If you try to sponsor your child before you meet the residency obligations, your sponsorship application will be refused and IRCC will move to revoke your PR status. Good Luck!

My consultant says I can apply for PR from India. It will be like adding my childs name to my PR application. I am thinking of trying this option.

There is no such option after landing. The only way to bring your child is through sponsorahip and this not an option either as long as you are not living in Canada. Dump this consultant.

This is impossible and your consultant has no idea what he is talking about. You need to fire your consultant.

Yes - this is a problem. As explained in my first response, if you apply to sponsor your child and don't meet the residency requirement, your child's application will be refused and your own PR status will be revoked. You will need to return to Canada and then live here until you meet the residency obligation before you will be able to sponsor your child for PR.

The Indian doctor advised her to avoid air travel due to medical reasons, now she has to deliver the baby in India only. I'm filling up forms for my new kid and stuck at one point in IMM1344. I added her as a co-signer in the form and while filling "co-signer eligibility assessment" there is one question # 3 which asks "Do you reside in Canada and in no other country?" what should be my answer (Yes or No?) as presently she is in India. The top heading says if you answer "No" to questions 1 to 3, you are not eligible to be a co-signer.

Now If I remove her as a co-signer then in check list (IMM5534) there is one section that says below "For Minor child - If you are a Minor Child and you are being sponsored by only one of the parents, your other parent must complete the Declaration from non-accompanying parent/ guardian (IMM5604). If you read this form this is if the spouse is not accompanying, which is not the case with me.

Please suggest, what are my options.

She is residing in India. There is no need for her to be a co-signer. IMM5534 doesn't apply in your situation because the other parent is already a PR.

Thanks for replying. But CIC website puts IMM5534 (check list) as a mandatory document. Are you saying IMM5604 doesn't apply?. Please clarify.

IMM5604 applies when one parent is immigrating to Canada with the child while the other parent is not immigrating and is remaining in their home country. Generally, this is when a couple is no longer together and so are not immigrating together.

Include a letter of explanation instead.

So are you saying that:
1. I don't make her co-signer and
2. Don't fill IMM5604 instead provide a letter of explanation
3. But Still need to complete the check list
