Hi,

I have question regarding the process for sponsorship. My partner was sponsored by his father through Family sponsoship then he will automatically receive his Permanent Residence in Canada. How will be the process for me and my daughter? How will he process the sponsorship? Do he need to go back in our country for us to be married and to change the status in the birthcertificate of our daughter?
 
So just to clarify a couple things 1)are you in a common law relationship with your partner 2)Were you not included in your partners PR application as a dependant ?
 
for the PR application, It was his father who applied for it not him. Do he need to update it since he was just sponsored by his dad.

You need to answer the questions you've been asked fully. Have you lived together for at least one full year? Also, is your daughter listed in his father's PR application?

Yes we lived together for morethan 1 year. Our daughter were not listed in the PR application because it was filed 2014 then my baby was born August 2015.

their visa was approved just this August 11, 2017. How will be the process for me and my daughter?
 
Did your common law boyfriend update that he was common law and had a child before he landed in Canada?
 
You need to tell us exactly under what conditions he was included in a Family Class application. Who was the primary applicant? Was he the dependent? Did his father sponsor him (which would mean his father is already Canadian) or was he included as a dependent in an application where his father was the primary applicant? More detailed information is needed to confirm the situation.

Based on the information you have provided so far, it's likely that you have several problems on your hands. First of all, if your partner was included as a dependent in a Family Class application - then he actually no longer qualifies as a dependent since he's common law with you. By saying he's single and using the visa he has received to land in Canada, he's committing misrepresentation. Secondly, by saying he's single and landing in Canada using the visa he's given, he can never sponsor you and your daughter since you weren't declared in the application. But again, you need to explain exactly how your partner was sponsored in order for us to help you.

Since he's common-law with you, he does not qualify as a dependent and should be removed from his fathers application. He does not qualify to get PR through his father.
