How did your hearing go?
Alicee my husband and I answered our questions good. The Minister's counsel rushed everything, he was also so rude. We didn't get a decision yet because the Minister's counsel had another hearing to attend the same day. When the judge asked him for final remarks, he said he couldn't give that at that time because he had another case and also he is going on vacation soon so we have to wait till middle of next month for him to give the judge his final report so that the judge can render a decision. So another two months of wait....so unfair. This appeal process is garbage. Innocent people are suffering.

Hey everyone, just a few questions. So hubby and I got refused for not genuine marriage. We appealed in January. I was sent a package a couple days ago with pretty much our application in there. Also letting us know to send all evidence 20days before the date, but not date was included from what my parents said.
I'm currently in Jamaica so I can't read the package my self, so I wanted to know, what's next?
They will send you a hearing date in few months or earlier or later. When your spouse received the blue book or the package, the refugee board or hearing board also receives it the same time. Then it gets in line for a hearing date schedule. You can submit the evidence before the 20 days as well. U need to start collecting all the 3veidences now. And submit 20 days prior to your hearing date or even before that. I had written a cover letter along the evidences and explained all the concerns that the interviewing officer had mentioned in the file. So it took only 10 minutes at the ADR when I was called for the hearing. I did everything myself since I was confident and didn't hire a lawyer but if u are not cofident then I must say hire a lawyer or consultant which could be costly though.

For the hearing you may be questioned on:

1. How you met? exact date and what took place in that meeting, what was said.
2. After the first meeting, when did you see each other again? How often?
3. When did you enter into a relationship ?
4.How did your relationship progress?
5.Who proposed?
6. Where was the proposal? What was said during the proposal?
7.Did you meet any of each other's family? Who and when?
8. What is the relationship between you and your spouse's family? Do they like you?
9. How did you plan your wedding? When did you start planning? Date of wedding
10. What happened on your wedding day?
11. Who attended the wedding ? Was both sides of the family there?
12.Where was the wedding held?
13.Did you have a reception after the ceremony?
14. How many people attended the wedding?
15. Was there a honeymoon? Where? When?
16. Did you consummate the marriage? When?
17. How many times did you travel to see your spouse?
18. From what date to what date did you travel to see your spouse?
19. Where did you stay during your visits? What did you do during each one?
20. Do you own joint assets?
21. Do you send your spouse money? Do they send you money? Why? How much? When?
22. How does your spouse complement you?
23. How are you compatible with each other?
24. What are your future plans?
25. If the appeal is refused what are your plans?
26. Does your spouse have family in Canada?
27. What is your day like? What is your spouse's day like? Describe everything that happens in a normal day
28. What work does your spouse do?
29. How much do they make a year? how much is that in Canadian dollars?
30. Why did you marry your spouse?
31. What qualities do you admire in your spouse?
32. How do you communicate? How often? What do you talk about?
33. Has your spouse given you gifts? what and when? Have you given your spouse gifts?
I had watched a few hearings and the above are the must ask questions at the appeal. You have to make sure you and your spouse are at the same page when answering these questions. Also you have to make sure your answers or the evidence that you submitted matches the forms that you fill out in the bluebook. I have seen couples even with lawyer/counsel to help them in the appeal but they fail to follow the events in the bluebook and the minister counsel use this as a weapon and it will greatly impact the credibility of the witnesses.

It's usually 3-4 years after you've put in the application. Things happen over the intervening time. Memories fade, especially with respect to minor details like sequence of events, dates, etc. Your perspective on certain events are coloured by personal experience. Two people can experience the same thing together, yet walk away with totally different interpretations. I'd much rather people relate how they feel from the heart, than give memorized and rehearsed answers. But that would most assuredly get your appeal dismissed. Got to play the game. Don't contradict each other, and don't contradict yourself.

Spoke to an agent at CIC call center Monday and was told that the background d was complete as of June 29. It is now 7 months since we won our ADR Dec 20 2016. Does anyone have an idea when we might get a request for the passport and visa? This has been a long stressful process 3 years since we filed our spousal application .

Do you have your MP involved?
With an appeal their hands are tied. They can't do much of anything. But you have won and waited longer than normal. Get him or her up to speed if they aren't already. I kept bothering the mp's assistants since day 1. I believe sometimes their involvement helps.

I had emailed Matthew Jeffery before and he said he charges $150 for consultation fee and $5000 to do a case, also he told me that the ADR process will take 1 year.
Yes he charges a consultation fee but if you retain him, it will be included in the overall fee that he charges to do a case.
I sent you my lawyer info in your inbox.
Hi,
I live in Toronto. I am having a Family Sponsorship Appeal case. I need a good lawyer charging reasonable fee like the one you had to go thru this case. You said the lawyer that you had charged 3000 for your appeal case. Please help. May I have the lawyer info that you before? thanks

Try and find out how the lawyers appeal cases had turned out. Yes they want to make money, some may be more greedy. However when mine said in appx 50 cases he's handled he has lost one. The one he lost was because the wife being sponsored, testified she had a boyfriend at their appeal. So not his fault. Also he quoted me about 5 grand 2 yrs ago. He stuck with same quote. I'm in Saskatchewan however.
$3000 may seem a better option because we all want to pay less. But make sure the lawyer is good. You wait so long and pay enough you need to make absolute sure the lawyer knows what they are doing.

I have involved my MP since the time line expired originally for our spousal application as well as our Senator . I called my MP's office every month since we won our appeal. My last call was Friday July 7 and have not heard back from them yet. They have always told me that they cannot get involved however they get different answers then I do when I call the CIC call center.

Try ombudsman then. Or your provincial immigration minister. Is the mp office close by?

I live in Prince Edward Island and we do not have an ombudsman but will try to contact the Provincial Immigration Representative
