Thank you @sylvain1. I went to the MP office. They said they will request the file, however they can not get them to reconsider. So I guess I will have to reapply. I got the letter and it states that in my case not enough evidence was provided.
I am reapplying with 10 letters from friends and family. Do you think that's enough?
I agree with @profiler you should have received a procedural fairness letter before refusal. That's probably accurate that the MP cannot change the decision, but they might be able to ask why there was no procedural fairness letter, which could trigger a reconsideration from CIC. I would not put too much hope, but it worth trying.
The MP will likely not be in his local office before next week, they are sitting in Ottawa for one more week.
Was the lack of evidence for relationship and/or cohabitation?
If you reapply, make sure to put more proofs than what is normally required.
Best of luck!

We used same courier package, different heavy paperclips to separate the packages.

So, he'd need a visitor visa either way.

if he applies inland, and supply the OWP package too, he'd have implied status until they decide.

It would be 12 months either way, but inland, he'd be able to start his life here, and you can be together...

Just a thought

But if he comes here as a tourist, applying inland doesn't mean you need to actually LIVE here?

And what about kid that need the medical test, he would have to get back to Nica meanwhile to take care of this, and I read if you apply inland and go back to your country your demand can get refused...

Hey guys,

So its been 2 weeks since we sent the proof of cohabitation and relationship to CIC , but no update yet from them. There is my husband's only brother's marriage which is being postponed since the last year , but we dont trust CIC how long will they take for the final landing interview, coz now the wait is getting frustrating , so we have decided to go to our home country in end of August and return in the beginning of October.Hopefully . We won't be having any problems in returning because we have already talked to one of our friends regarding this who is a border security officer. So still I just wanted to confirm , is anyone from this forum who has also traveled outside during the inland immigration process? and if possible can Profiler and others please give there comments on our decision.

Thanks

So I don't know the situation with the child, but if the child is coming, they could come to Canada in the same visit. They can remain in Canada with their parent, and can even attend school. So the medical can be done here for both.

Keep in mind, that if the child will be coming here, that he will need to get the permission to travel and to immigrate from his ex or a court. If the child is remaining in Nica, can the medical be completed by his ex?

Yes you shouldn't leave, but if the PA had to, as long as they're not refused re-entry, then short trips are generally tolerated by CIC. The general rule of thumb is less than 1 month.

My wife came here as a visitor. Married here. Went home to finalize affairs and returned. We applied while she was a visitor for PR and OWP. She is now a PR. No questions from CIC at all...

Regarding "living here" -- isn't that the plan? When you apply for an inland PR, it is expect you are using a Canadian address, and that you will remain in Canada until processing is finished (minus short trips, if need be?).

EDIT: In case you wanted to check up on the idea of the dependent child being here and studying, here is a CIC link:
http://www.cic.gc.ca/english/study/study-minors.asp

From there, this is the important bits:
"
Exceptions: Studying without a study permit
In some cases, minor children do not need a study permit to study in Canada. These cases include:

  • minor children attending kindergarten;
  • minor children who are refugees or refugee claimants, or whose parents are refugees or refugee claimants; and
  • minor children who are already in Canada with parents who are allowed to work or study in Canada, and who want to attend pre-school, primary or secondary school.
When minor children studying in Canada without a permit reach the age of majority (turn 18 or 19 depending on the province or territory), they must apply for a permit if they want to continue studying.
"

When the PA applies for an OWP, their dependent minor can study school (Pre, Primary and Secondary schools) in Canada without a study permit.

You applied in may 2016? That's quite a risk but hopefully you're processed and landed before then. It's really in the discretion of the officer to let you back in.

It'll take a month to get your file looked at again.

I can't comment on what your friend said. I can say they will assess you for dual intent. So bring proof of ties to your country of origin too.

My concern about leaving would be: if they email you to land, and you're not in range of the 'net or you cannot return home. You'd need to check emails daily so you don't miss that message...

If they land and no PR Card, they can visit a Canadian Embassy or High Commission with a CoPR to pay $50 to get a travel document to return.

Yes, once again if they land before leaving.

The MPs usually try to convince or ask for reconsideration. But I agree, it's grasping.

I'm more interested why MPs are so lazy.. also, what happened to the document request?

I don't know if it's laziness or just their personal opinion/interest regarding immigration.

I was wishful thinking there... Not to get all preachy, but I don't care if you have interest or an opinion -- if I need your help, and you are representing me -- you'd better do your damn job!

/rant

Granted it's an uphill fight for sure. But that really should not change whether they help or not.. I noted they (the MP) are Cons.

I agree, they should be helping whatever their opinions are, and maybe a lot of them do. But some are clearly not helping. We had a lot of help from the previous MP when we wanted my wife's family to come for our wedding. Was it because it was an NDP or because they were just doing their job? Now we have a conservative, I felt listened when we met his employees when we were desperately waiting for SA and AIP, but I didn't feel they were willing to push for us.
