Hello,

I am applying under family class with my Common Law Partner sponsoring me.

I am living in Canada, working (part-time) with a valid post-graduation open work permit that expires next month. I have been waiting a bit longer than expected for some documents, which I should have tomorrow. Once I get them, the application is being sent.

I have talked to a settlement volunteer at the local library, and she told me I should send in my open work permit extension with the rest of my application. She said I would remain under implied status if I did this, and so I would be able to continue to work while my application was being processed.

This seems correct... but I have been unable to find any other information about this. I have looked at the forms here and I did not see anyone with a similar situation, just to confirm this.

Does anyone know if this would be the correct action to take? Would it be better to apply for the extension online separate from Common Law Partner application?
 
Does anyone know if I should send the separate work permit (extension) form or should I just include it in the Common Law Partner Sponsorship application?

If you've reached the maximum allowable time of your PGWP based on your schooling completed, then the PGWP is non-extendable and will not benefit from implied status. The OWP you will apply for with inland PR app, is an entirely new class of work permit, NOT an extension of the PGWP. Also family class apps do not give benefit of a bridging work permit.

So when your PGWP expires you need to stop working, and can continue working when you receive the OWP from inland PR app.

Thank you for your response. I actually just got off the phone with the CIC agent, and he said I should send the work permit application together with the PR application.

I have not reached the maximum allowable time to work in Canada, as my PGWP expired when my old passport expired. I have renewed my passport. My initial PGWP was from May 2016 to July 2017, but I was a student for 2 years
