Hello friends,
I have an urgent question and I am hoping somebody can help me out.
I got my PR confirmation and I am preparing to do my landing soon. The problem is that 8 month ago, I had a proxy verbal marriage that was not documented, so, there is no marriage certificate. I lived with my wife for 8 Month and half. Should I disclose this when I land? However, I can not get a prove of marriage, or wait till I get my PR and then get legal official marriage and then have a sponsorship. please advice.

http://www.cic.gc.ca/english/information/applications/guides/5289ETOC.asp#who - Try seeing if your situation falls under the Sponsor eligibility. Anyhow, I do not believe your disclosure is going to help anything. Having a legal marriage and going through the proper process seems like the best route.

Thanks you so much for your reply. No, I am not falling under the sponsor eligibility for two three reasons: proxy marriage, No marriage certificate documented and finally less than one year of common law relation. I am just worried if not disclosing that situation may be considered some sort of misrepresentation. That's why I am seeking advice, should I go a head with landing as this is not a legal marriage and CIC does not recognize it.

You mentioned that you already have a PR confirmation. Is that correct? And if so, wouldn't that mean that your application (whichever route you used) is complete?

From what you've explained, I gathered that you're a new Permanent Resident waiting to land in Canada after which you will try to get your spouse to come to Canada. Is that a correct assessment? Please elaborate.

Yes, this is actually true. I am just waiting to land. My spouse actually is in Canada on a work permit. arrived 8 month ago. I have been in Canada for many years, so we had a phone marriage that was not documented when she was overseas, then she came to Canada on her own.

I'm a bit unsure about your situation but as I see it, you are not married yet. I would suggest getting legally married then sponsor your wife. Verbal marriage is not a legal, official marriage and so in that sense you are not really hiding anything from the immigration.

I believe so as well, but people talk about that issue a lot, so I got worried and I wanted to get another opinion. the other thing, how long do I have to wait after Landing to get married?

You're welcome. Hopefully I've helped a bit. If you guys know each other for a while and formal wedding was in the plan I'd say go ahead and then maybe live together for a while and then apply.

If you and the sponsor leaving for about 12 months you are consider as common law with conjugal u just need to prove that u guys have conjugal property or joint like utility and everything or if you guys decided to get married it will be spousal sponsorship thats why there is 2 k8nds of sponsoring a spouse or common law. Hope this help. Goodluck!

thank you so much. we are not common in law. so, in this case, when I do my landing, I do not have to disclose that marriage as it not legal?
